The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as:

For the purpose of grading Canterbury Ranch Subdivision.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard Management regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Management Regulations require a new application, approval, and issuance of an additional Floodplain Use Permit.

The following conditions apply to this permit (see Tucson Code of Ordinances Chapter 26):


1) All work shall conform to the stamped/approved Tentative Plat, Grading Plans (sealed on 12 January 2004), and Final Drainage Report for Canterbury Ranch, sealed on 27 February 2004, prepared by The WLB Group Inc. Engineering LLC, which are made a part of this permit.
2) The existing drainage patterns at the property lines shall not be obstructed, other than as may be shown on the approved Tentative Plat, Grading Plans and/or described in the Drainage Report.
3) No silt fencing or straw bales shall be placed in the "No-Name Wash" at the southeast corner of the site.
4) In cases where the average diameter and thickness (D50 and T) of riprap have discrepancies between details and/or plan sheets, or are unclear, use the larger dimensioning of the two.
5) All grading shall meet the recommendations of the Geotechnical Report and addendum prepared by LMT Engineering, sealed 27 January 2004, for this project.
6) Additional percolation tests shall be performed prior to request for grading inspection for each retention basin, demonstrating conformance to the drainage report and City of Tucson Development Standards and Code requirements.
7) Documentation describing the north drainage easement shall be submitted to Engineering Division, Development Services Department for archiving purposes.
8) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
9) Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T04OT0131 - fOR INFORMATION PLEASE CALL 791-5550."
10) A right-of-way permit is required for any development, excavation, or construction activity within the right of way. Contact Tucson Department of Transportation - Permits and Codes Section, Engineering Division at 791-5100 for questions relating to right of way permit information.
11) This permit becomes invalid and is subject to an additional floodplain permit application and review, if any proposed or required modifications change the configuration of this site development.
12) Any walls to be proposed will require a separate floodplain use permit application and approval prior to construction. Please call Development Services Department at 791-5550 for questions.

This Floodplain Use Permit will be automatically revoked and becomes invalid, if development onsite results in non-compliance with conditions set forth in this permit. This permit will expire one year from its date of issue. Renewal of this permit will require a new application, review, and approval by the City of Tucson, Development Services Department, Engineering Division.
