After review of the site plan the following items must be addressed. 1. Per the revised site plan, the loading zones have been relocated out of the right of way and one space has been placed in the rear of the building. Per the loading zone calculation three loading spaces are required but only one space has been depicted. A variance will be required if the additional two spaces will not be provided. Previous Comment: This plan was originally reviewed for full code compliance in the year 2000. Any existing nonconforming status or use has been lost as a result of the full code compliance and change of use. The loading zones as depicted on the plan do not meet LUC requirements. The loading zones must be completely on site and cannot be placed in vehicular use areas such as over parking spaces or a PAAL. These loading zones do not meet code and would require a Board of Adjustment variance. In addition the loading zones may not be placed within right of way. There are remaining issues with the placement of the loading zones and there is nothing in the Board of Adjustment request about the loading zones. Please clarify how and by what document the loading zones were approved as shown on the plan. 2. The relocation of the refuse enclosure is in a location that was not seen by the board of adjustments. The enclosure eliminates one of the parking spaces shown on the previous site plan. Please verify with Wayne Bogdan whether or not the relocation of the refuse enclosure makes a difference in the approval of the variances requested. The board of adjustment variances and conditions may have to be update based on the revised drawing. Provide something in writing from Wayne Bogdan.
