Approval is not recommended at this time. Please address the following comments: 1. This property is affected by regulatory flow in excess of 100 cubic feet/second (CFS) during the 100-year storm event, and must conform to floodplain development regulations - Chapter 26, Tucson Code. An engineering study review fee of $150.00 and floodplain use permit application fee of $50.00 will be required upon resubmittal. DRAINAGE REPORT: 2. In accordance with the City of Tucson's Standards Manual for Drainage Design and Floodplain Management (Development Standard 10-02.0), Sec. 2.3, the Hydrologic and Hydraulic Report submitted (as required by Sec. 26-11.2 A 2 (e), Tucson Code) must provide detailed discussion and analysis of the regulatory flow (170 cfs) from the 29th Street box culvert/storm drain system, discussed in section 2.1. 3. The report must reference and provide pertinent sheets of any "As-Built" drawings/improvement plans supporting the analysis and any determination of flow containment within the box culvert. 4. The report must demonstrate that the structure is not affected by regulatory flow (100-year storm) or, demonstrate conformance to floodplain use permit and floodway fringe development requirements, outlined in Sections 26-5.2, 26-11 and 26-11.2, at a minimum. 5. Omit reference in the report to the basin in section 1.6. * Subsequent comments may be necessary, depending upon the nature and extent of findings in the report * GENERAL COMMENTS: 6. A Floodplain Use Permit will be required prior to, or in conjunction with permit approval for the proposed tenant improvement. Please complete and submit a Floodplain Use Permit application with a resubmittal. 7. If a determination is made in the report that the structure is affected during the 100-year storm event, a determination must be made as to whether the existing structure is to be substantially improved, as defined by floodplain regulations (see comment # 8). 8. Substantial improvement means any reconstruction, repair, rehabilitation, addition or other improvement of a structure, the cost of which equals or exceeds fifty (50) percent of the market value of the structure before the "start of construction" of the improvement. If the value of the improvement exceeds 50% of the value of the existing structure, then substantial improvement requirements must be met, including full conformance to floodplain development requirements (floodway fringe development, floodproofing requirements, etc.), as defined in City Floodplain Regulations (Tucson Code, Sec. 26-2). 9. If the improvements to the existing structure amount to a substantial improvement, conformance to Section 26-4.1 - Nonconforming development - will be required. Subsection (a) "Improvements to, or Reconstruction of, Existing Nonconforming Development", states that "any structure which is substantially improved at a cost equal to or exceeding fifty (50) percent of the full cash value of the structure as shown on the latest assessment rolls of the county assessor either (a) before the improvement or repair is started, or (b) if the structure has been damaged and is being restored, before the damage occurred, shall conform to these regulations". This information must be determined by submittal of the necessary documents (see comment # 10). A recent appraisal, specifying the value of the structure itself may be necessary and/or preferred, should a "substantial improvement" apply under this permit application. 10. The floodplain permit application must include a licensed contractor's estimate, itemizing the proposed improvements to the EXISTING STRUCTURE, to be performed under this permit. Materials, labor, and overhead must be included in the estimate. 11.
