Presidio Road Site Plan Transmittal date: 2nd Review July 29, 2004 COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed. 1. Patricia Gehlen, Zoning Review Section Supervisor has rescinded the site plan approval for this project. During the past several months' changes in the LUC have been made related to the definition of bedroom and the number of bedrooms as it relates to residential development. As you are aware the number of parking spaces for multi-family development is based on the number of bedrooms per unit. The biggest item that has changed and is applicable through out the City is the definition for bedroom. LUC definition as follows: Bedroom. The term bedroom shall include all of the following. A. Any room that is designated as a bedroom. B. Any enclosed room which has a minimum area of sixty (60) square feet and has an accessible opening to the exterior of the building in compliance with the International Building Code (IBC), whether termed a studio, family room, study, den, bonus room, or any other name, except for a living room, dining room, kitchen, and bathrooms. C. Any room designated as a bedroom for the purpose of any other code requirement. The largest dwelling unit although first reviewed as two bedroom unit requiring two parking spaces is now considered as five bedroom unit requiring 2.5 parking spaces. The number of parking spaces required for the development is 11.5, which must be rounded up to 12. The development is one parking space short. In order to attain site plan approval one additional parking space must be provided or a board of adjustment variance for the parking space will be required. 2. Also, the LDO extension has expired and the application must be processed again. Please contact Frank Podgorski for more information of the expired LDO and on the process to re-apply for an LDO. 3. The site plan or the building plans cannot be approved until both processes have been completed. This plan has been through the LDO process and was approved. The only change from this existing plan and what is required on the plan is one additional parking space or a Board of Adjustment variance for the parking space. If the applicant or owner elects to apply for a variance for the additional parking space the building setback deficiencies can also be processed through the Board of Adjustments.
