Resubmit F.U.P. with assign permit number along with the cost estimate by a licensed contractor and the assessed value of the structure.

COMMENTS: Please resubmit revised drawings along with redlines and a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.



1. The previous comment stated that the three sites were reviewed as one site. Obviously this was not the intention because the site plan for the beauty salon is the only plan that was submitted for review. The following comments are specifically for the proposed beauty salon at address 426 E. 9th Street. Please address the comments and resubmit the revised site plan along with redline and response comments.

(Previous Comment: ***Note: This project will be reviewed as an overall site plan with three different uses. Although an extension has been granted for the Board of Adjustment case C10-01-32 the plan submitted for review does not address the two new uses, Personal Service Use; Beauty Salon and Residential Use: Multifamily apartments. The plan must be revised to include all required LUC data information for each one of the proposed uses.)

I have also been made aware that an additional Board of Adjustment case decision is pending. Both Board of Adjustment case numbers, date of approvals, and conditions of approval must be listed on the plan unless the new supercedes the previous case. Additional comments may be forthcoming due to conditions of approval for the B. of A.

2. The previous comment related to the sidewalk was based on the three sites functioning as one overall commercial site. I acknowledge that a sidewalk has been provided on Hoff to provide access to the building. What is not labeled on the plan is whether the sidewalk is accessible route that meets maximum allowed slope of 12: 1. Steps or stairs anywhere within the sidewalk area proposed accessibility is allowed unless a separate ramp with railing if necessary is provided next to the accessible route. Demonstrate on the plan how this requirement will comply.

(Previous Comment: In addition to the required sidewalk as shown on the plan the three sites must be provided with an accessible route that meets ADA compliance. The accessible route may be the same route as the existing or proposed sidewalks as long as the sidewalks meet the minimum slope requirements of 12:1. Stairs will not meet the requirements. The accessible route may be placed in a different location but must connect to onsite circulation that leads the pedestrian to the building.)

Also per DS 2-08.4.1.A, a concrete sidewalk that provides pedestrian access from Hoff Avenue to the site must be provided and must interconnect to the onsite pedestrian circulation/sidewalk. All sidewalks must be a minimum of four feet wide. Dimension the width of the sidewalks, demonstrate onsite circulation for address 426, and 430 and label the construction material for the sidewalks, concrete, pavers, brick etc. DS 2-02.2.1.A.

3. I have discussed the proposed Personal Service use: Beauty Salon with Wayne Bogdan. Per our discussion related to the previous Board of Adjustment approval the case was reviewed and variances granted based on proposed Office and Retail uses. Per Wayne, this proposed use must go back to the Board of Adjustment for consideration. Zoning will not approve the plan until resolution or a new Board of Adjustment approval has been granted. Call Wayne Bogdan at 791-4541 for more information on the process and his determination.

(Prior approvals such as Board of Adjustment must be listed on the plan. The case number, the variances requested, the variances approved, and the conditions of approval must be listed. A copy of the most recent B. of A. Notice of Decision letter must be submitted with the subsequent submittal. DS 2-02.2.1.A.38)
