A Flood Use Permit is denied.

The following items must be revised or added to the plan. Please include a response letter with the next submittal that states how all comments have been addressed.

Resubmittal Required: Flood Use Permit Application, Plans, Drainage Report

1. FEMA Panel 1643 shows that the entire property is in Special Flood Hazard Zone AE. Place a note on the plan to that effect.

2. Hydrology Report is required which meets the format requirements of the Standards Manual for Drainage Design and Floodplain Management SMDDFM 2.3.1. The Report must be sealed by a Registered Professional Civil Engineer.

3. The Hydrology Report must provide an encroachment analysis which shows that all proposed structures and all existing structures built in or after 1982 including additions and walls will not increase the base flood elevation by more than .1 ft.

4. The Hydrology Report must also address offsite to onsite flows and onsite to offsite flows. Stormwater must be accepted and released essentially at the same locations and with the same magnitudes as existed under pre-developed conditions.

4. The Hydrology Report must determine the erosion hazard setback limit. This limit must be shown on the Site Plan. New detached structures will not be allowed in the erosion hazard setback. A structure is defined in the floodplain ordinance as a walled and/or roofed building.

5. Any non-conforming structure which is improved at a cost equal to or exceeding fifty percent of the value of that structure must conform to Chapter 26 of the Tucson Code (Floodplain Ordinance).

6. The appraisal provided in the submittal does not include the value of all improvements made to the original non-conforming structure. The appraisal must include the value of all improvements made in or after 1982 as a separate line item from the structure that existed prior to 1982. The assessors records show 941 square feet of additions added on in 1990. The garage (588 square feet) was also added on at that time.

7. Provide an estimate by a licensed contractor for the cost of all proposed improvements.

8. If the value of the proposed improvements together with the value of the existing improvements made in or after 1982 equal or exceed fifty percent of the value of the non-conforming structure, the entire structure must be brought into conformance with Chapter 26 of the Tucson Code.

9. Appeals and Variances. See Chapter 26-12 for information and procedures concerning appeals and variances concerning the floodplain ordinance.
