Saint Mary's Road PROPERTY OWNER: Carondelet St. Mary's Hospital and Health Center The applicant is authorized to use a portion of the City of Tucson Special Flood Hazard Area, specifically described as: Parcel 1: 116-15-087J PART OF FRAC LOTS 2 10 11 & PT OF FRAC LOT 1 LYG W OF SILVERBELL & S OF ST MARY'S RD & N OF ANKLAM RD 15.38 AC SEC 10-14-13 (RD 5516/38) (7885/1932 7892/248) (4757/825 8268/986) For the purpose of improvements to an existing, non-conforming floodprone structure. In reviewing this Floodplain Use Permit application for improvements to an existing floodprone structure, it has been concluded that the cumulative value of improvements to this structure, as supported by documentation provided by the applicant, is less than 50 % of the current value of the existing structure. When the cumulative improvements equal or exceed 50% of the current value of the structure; no other improvements will be permitted unless the entire structure is brought into compliance with the City of Tucson Floodplain and Erosion Hazard Area Regulations. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard Area Regulations, and are bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations require application for, review and approval of an additional Floodplain Use Permit. This floodplain use permit is issued with the following conditions: 1. A qualified appraisal shall be provided to Development Services Department - Engineering Division. The appraisal shall serve as documentation, as required, demonstrating that the value of the improvements to this structure, under this permit is less than 50% of the current value of the existing structure. 2. All future improvements will be cumulative in percentage, to include this project. 3. A Letter of Map Revision (LOMR) shall be submitted to the Federal Emergency Management Agency (FEMA) within 180 days of completion of construction of the addition permitted herein. The date for obtaining the LOMR is determined by FEMA. By Federal law, submittal of the LOMR to FEMA shall occur within 180 days from date of completion of Emergency Department construction. 4. The new addition's floor elevation may not be lower than the existing floor elevation. Lowest floor elevation certification letters (using FEMA datum) from a registered Land Surveyor for the existing structure and proposed addition for the Emergency Department building shall be submitted to the City of Tucson, Development Services Department, Engineering Division prior to issuance of the final certificate of occupancy (C of O). 5. Roof drainage and scuppers shall be provided for appropriate conveyance of stormwater under sidewalk areas. 6. This Floodplain Use Permit is issued concurrently with the Grading plans/permit. Copies of these documents shall be kept in a readily accessible location on site at all times. 7. The proposed addition shall not impose conditions that would increase the flood damage potential to the combined proposed and existing building, by greater than 50 percent of the existing structure's value. 8. If existing structures (such as walls) provide floodproofing for the proposed structures, provide certification(s) of such. 9. Any future permanent, freestanding walls shall have separate floodplain use permit applications submitted to this office for review and approval. 10. Any work performed offsite shall be agreed to and notarized by any adjacent property owners. Any work performed within the public right-of-way will require permitting through Permits & Codes Section, Engineering Division, Department of Transportation. 11. Upon project completion, provide a copy of as-built grading plans with a copy of the substantial completion letter from the project engineer stating that there will be no adverse impact to adjacent property, either upstream or downstream as a result of this development, and that the project has been built in conformance to the City of Tucson and FEMA regulations, with acknowledgment that there may be risks depending on response to FEMA's submittal. The applicant attests to the fact that the plans and documents submitted for the proposed improvements to the existing building, and that all proposed additions, improvements or repairs to the building are included in the construction plans and/or documents submitted herewith. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. This permit will expire 30 months from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division. The applicant is authorized by the City Engineer to receive a floodplain use permit subject to the above referenced conditions and restrictions.
