Conditions for Floodplain Use Permit #T03OT00165 (Proposed apartment complex at 446 N. Campbell Avenue, Tucson, AZ; Property Owner: La Colonia Seis Apartments L.L.C., 4280 N. Campbell Avenue, Tucson, AZ):

The applicant is authorized to use a portion of the flood hazard area in the City of Tucson on the property described as : 446 N. Campbell Ave for the purpose of constructing an apartment complex and appurtenant structures and utilities.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following conditions shall apply to this permit.

1. All work shall conform to the attached plans, which is made part of this permit.

2. Any building shall be placed on a permanent foundation to be backfilled with appropriate soil material compacted to the density as specified in the specifications.

3. Special inspection is required. The lowest finish floor of building numbers 6, 7, 8, and 9 (and associated utilities) on the property under this permit shall be placed at a minimum elevation of 2436.99 (NAVD88). Elevation Certificates must be complete and include any necessary bulding diagrams if the structure does not conform to those contained in the instructions. This certification must be completed and returned to Development Services Department, the Office of the City Engineer, Engineering Section on the 1st. Floor of the County/City Public Works Building at 201 N. Stone Avenue. This Certification must be completed and returned to the Development Services Department prior to final inspection of the building, occupancy of the building, or issuance of certificate of occupancy for the building. Please call the Development Services Department at 791-5550 or 740-6970 (IVR) for inspection.

4. The existing drainage patterns at the property lines shall not be obstructed.

5. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Permit No. T03OT00165. For information please call 791-5550."

6. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.

7. This permit becomes invalid and is subject to additional floodplain review, if any required development permit(s) changes the configuration of the structure and or site development. Said development must conform to any other permit issued for construction on this site.

This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Section.

Note that final inspection or certificate of occupancy will be on hold until the Elevation Certificate is completed and returned to our office.

The applicant is authorized by the City Engineer to receive a floodplain use permit subject to the above referenced conditions and restrictions.
