The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as:

Desert Vista Terrace subdivision lots 1-183 and Common Areas "A", "B", & "C" at 4295 East Valencia Road, Tucson Arizona 85706, within the south portion of Township 15 South, Range 14 East, Section 10, Lat. 32° 8' 9" Long 110° 54' 2",

for the purpose of placing fill for building pads and constructing subdivision improvements including drainage structures within the floodplain for the Desert Vista Terrace subdivision project as depicted in the Grading Plan for Desert Vista Terrace, dated 1/27/03.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following 12 conditions apply to this permit. (see Tucson Code of Ordinances Chapter 26)

1) All work shall conform to the Rick Engineering documentation including: GRADING PLANS FOR DESERT VISTA TERRACE (dated 1/27/03), and DRAINAGE REPORT and addenda (dated 1/23/03), STORMWATER POLLUTION PREVENTION PLAN FOR DESERT VISTA TERRACE (Sept.16'02), and CLOMR-F (dated 8JAN03 case # 02-09-1441C) which are made part of this permit.
2) Any further disturbance within the floodplain than that outlined in the approved GRADING PLANS FOR DESERT VISTA TERRACE shall require separate grading and floodplain use permits.
3) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.
4) The existing drainage patterns at the property lines shall not be obstructed.
5) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the structure and / or site development.
6) Right-of-way Use Permits may be required for any erosion protection construction or other construction within the right of way.
7) Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T03OT00093. FOR INFORMATION PLEASE CALL 791-5550."
8) Please call Development Services Department at 791-5550 extension 1194 for inspection.
9) Any walls to be constructed will require a separate permit.
10) Any building shall be placed on a engineered pad, compacted to 95% density, extending twenty-five (25) feet beyond the buildings foundation, unless a study prepared by a state-registered professional civil engineer and approved by the city engineer shows that a lesser distance is acceptable.
11) The finish pad elevations for those lots within the FEMA Floodplain Limit Line (lots 135-139, and 89-107) shall be certified by a Registered Land Surveyor. Pad Elevation Certificates shall be submitted upon completion of grading for these buildings and returned to the Records Department, on the 1st floor of the County/City Public Works Building at 201 North Stone Avenue, Tucson Arizona 85726. This Certification must be completed immediately after the finished floor is constructed. Please call Development Services Department at 791-5550 or 740-6970 (IVR) for inspection prior to any wall construction.
12) Adhere to specifications outlined in Section C, C2 of the elevation certificate.

This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Section.
