COMMENTS: Comments related to deficiencies that require a board of adjustment variance.

1. The minimum width of PAAL for two-way traffic is 24 feet, LUC table 3.3.7-I and development standards 3-05.2.1.C.1.

The PAAL as shown on the plan varies in width from 24 feet to a minimum 22.42 feet. The portion of the PAAL that is 24 feet wide starts at the driveway entrance and from the driveway entrance and runs east approximately 50 feet. The PAAL width begins to taper at 50 feet east of the driveway entrance to 22.42 feet.

The width of the PAAL does not meet all the width requirements necessary to comply with the land use code section 3.3.7-I, development standards, DS 2-08.4.1.F (to allow the pedestrian refuge are between the PAAL and a parking space, DS 3-05.2.2.B.1 (Pedestrian Refuge width to minimum of three feet), DS 3-05.2.2.B.3 (two-foot separation between PAAL and screen wall), and DS 3-05.2.2.D (Back-up spur).

The site plan for this development had previously been approved by DSD but width approval by DSMR for items in development standards DS 2-08.4.1.F, 3-05.2.1.C.1, DS 3-05.2.2.B.1, DS 3-05.2.2.B.3, and DS 3-05.2.2.D

I acknowledge that the Board of Adjustments cannot consider all these items for a variance. The development standards sections have been included in the comments as a result of the constraints on the site do to field conditions, which were not correctly verified prior to start of construction. All development standards will be re-reviewed through a DSMR process or other process yet to be determined by Patricia Gehlen or Craig Gross.

2. Due to unverified street property line location, construction, and placement of the duplex building the street building setback cannot be met as previously approved. Upon completion of a survey the street property line was not drawn correctly on the previously approved site plan. Based on the survey drawing, the placement of the duplex although meeting setbacks on the approved plan does not meet the minimum building setback of one and one-half times the height of the building. The required street building setback must be 30 feet. The building was constructed and inspected with a floor plan for the second story, which was not approved on the original floor plans. The second floor extends into the building setback by approximately two and one-half feet.

A variance for the street property line setback is required. LUC section 3.2.6.5.B, minimum building setback required is based on the greatest of 20 feet or the one and one-half the height of the structure. The height of the structure is 20 feet from design grade. Minimum building setback required equals 30 feet.
