Transmittal date: 1st Review July 2, 2003

COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Add the legal description of the property on sheet one. DS 2092.2.1.A.2

2. Please add to the location map, the COT/Pima County Corporate limits, section corners, and add the section township and range in which this property is located. DS 2-02.2.1.A.4

3. Per a site inspection conducted on June 30, 2003, it was noted that the site plan does not accurately depict the existing conditions.
* The parking area along the north side of the property is not striped for angled parking.
* The dumpster location as depicted on the plan is not the location on site plan.
* An enclosed structure located on the northeast corner of the building is existing but not shown on the property.

The following items are items have been noted as a result of the site inspection and review of plans and records in the COT DSD Records section.
* Two structures on the site of which one appears on the site plan that was submitted for this expansion review do not appear to have been approved on previous site plans or building expansion plans.
* In addition the area that appears to house mechanical equipment adjacent to the north side of the building does not appear on any previously approved plans.
* The required loading zone, which was approved on a previous site plan, could not be verified on the site. The maneuvering area into and out of the loading zone was approved through the north side of the building. (The loading space is not allowed to be placed within the PAAL area.)
* The existing planter along the southeast corner of the building as depicted on the plan does not match the as built planter on the site. The planter on the site appears to be larger and encroaches onto the PAAL area along the east side of the building.

Expansions are cumulative and would be applicable from the last full code compliance. The building expansions must be listed on the plan. The date of the expansion and the square footage must be stated. A building expansion was in 1982 and a small expansion was approved in 1997. As indicated in one of the previous comments, permits or approved plans could not be found to verify the approval of the addition of the two structures along the north side of the building including the area that houses mechanical equipment. These two structures must be included in the building expansion along with the expansion approved in 1982, 1997, and today's proposed expansion. It appears that percent expansion will exceed the 25% expansion and therefore the entire site must be brought into full code compliance. Additional comments will be forthcoming on the subsequent site plan review based on the response comments from the owner/consultant. I have attached additional plan sheets from the DSD records section for your convenience and review. This plan will be reviewed by Zoning as a less than 25% expansion but the subsequent review will include comments for full code compliance. Full code compliance for Zoning compliance includes but is not limited; landscaping, screening, pedestrian circulation, loading zones, bicycle parking, handicap parking and accessible pedestrian circulation, vehicle parking with required PAAL widths, parking spaces, wheel stops etc. DS 2-02.2.1.A.6

4. No records or approved site plan could be found that indicates approval for required vehicle parking to be placed in the existing and future Fort Lowell right-of-way or for the re-striping of the parking lot. If a temporary revocable easement (TRE) was granted by the City of Tucson to allow the use of the Fort Lowell right-of-way please forward a copy of the document with the next site plan submittal. As indicated in a comment three (3), the parking spaces along the north property line are not striped as depicted on the plan. The three (3) parallel parking spaces adjacent to the northwest side of the building are not striped on the site as depicted on the plan. Per a previous approved site plan, wheel stops were required and were to be provided along the north property line. The wheel stops were (are not) physically provided on site. If cross parking and cross access between the restaurant and the business immediately to the north occurs please provide a copy of the recorded agreement. Additional comments on the vehicle parking will be forthcoming. DS 2-02.2.1.A.8

5. Future comments will be forthcoming on bicycle parking based on the subsequent review and response comments as it relates to the overall building expansion. DS 2-02.2.1.A.9

6. Existing and future sight visibility triangles must be shown. Vehicle parking spaces are not allowed with the sight visibility triangles. Additional comment will be forthcoming on subsequent reviews. DS 2-02.2.1.A.10

7. Per a 1977 approved site plan all ingress/egress entrances and PAAL areas were 24 feet wide. The PAALs and driveway entrances have bee reduced to less than 24 feet. Clarify if the driveway entrances are 24 feet or less. Dimension as required. DS 2-02.2.1.A.11

8. Per the proposed site plan the parking spaces along the west side of the building are to remain. The proposed building expansion will put the new west building wall at the front edge of the parking spaces. Per DS 2-08.4.1.C a minimum of a four feet wide sidewalk is required between the parking spaces and the building. The Parking spaces are not allowed to overhang onto the sidewalk unless the sidewalk is six and one-half feet wide or wider. The sidewalk width cannot be reduced to less than four feet. The sidewalk must be physically separated from the vehicular use area by providing a raised sidewalk, wheel stops that prevent the car from overhanging onto the sidewalk area, or curbing. The sidewalk must be constructed of Portland cement concrete four inches thick. The sidewalk must connect to on site pedestrian circulation and must be made handicap accessible (ramps) where required. In addition if the PAAL area along the east side of the building is to remain a minimum of a five feet wide pedestrian refuge area with a four feet wide sidewalk is required. The refuge area must connect to the on site pedestrian circulation path. DS 2-02.2.1.A.12

9. Show all existing signage. The location type and size must be labeled. DS 2-02.2.1.A.13

10. As indicated in a previous comment the loading space that was approved on a previous plan could not be verified out on the field. A 12 feet wide by 35 feet long loading space is required for this development. Please show the loading zone as approved by the previously approved site plan. DS 2-02.2.1.A.14

11. The building setbacks from the Fort Lowell Road future back of curb location must be added to the plan. Please add the future curb and sidewalk location based on the 100 feet right-of-way per the MS&R plan. DS 2-02.2.1.A.21

12. If applicable indicate any existing or proposed freestanding lighting. DS 2-02.2.1.A.25

13. Revise the use classification to Food Service DD 33, Subject to LUC section 3.4.5.6.C. Please clarify If current certificate of occupancy is for the Fort Lowell Depot Bar and Grill. The last C of O on file is for a restaurant named Churchill's Ft. Lowell Depot. Provide a copy of the current C of O. Clarify if outside ding is proposed for the enlarged outside area. DS 2-02.2.1.A.31

14. As indicated in previous comments, additional comments may be forthcoming based on the cumulative building expansion and response letter.
