COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. In order for the this project to be developed as proposed, the parcel must be rezoned to R-3 minimum or the developer/owner must apply to the Board of Adjustment for variances related to following Land Use Code items. Required site area, allowed lot coverage, required building setbacks for the existing building, which does not meet the required building setback of 10 feet or ¾ the height, and for the required amount of vehicle parking spaces.

A. The minimum site area for the proposed use (Religious Use DD "12") is 20,000 square feet. The existing property is 16, 500 square feet. LUC section 3.2.3.2.A, development criteria matrix tables.
B. The maximum lot coverage allowed is 60 percent. The proposed lot coverage is 64.1 percent. LUC section 3.2.3.2.A, development criteria matrix tables.
C. The minimum building setback when adjacent to R-1 zoning is based on the greatest of 10 feet or ¾ the height of the building structures. The existing structure enjoys non-conforming building setbacks adjacent to the north property line. (Please show existing building setback ± 2' on the site plan.) The change of use requires that the site be brought into full code compliance including building setbacks for the existing building. LUC sections 3.2.3.2.A. DD "12" perimeter yards indicator 'CC' and section 3.2.6.4 Perimeter Yard Width Matrix.
D. The amount of parking spaces has been determined at one (1) space per 50 square feet of the proposed assembly area, which is indicated in the notes as 1500 square feet. Thirty spaces are required for the Religious Use. Parking is not required for the existing home if the home is to be used as an accessory structure such as a caretaker home or Parsonage. LUC section 3.3.4. (One handicapped vehicle parking space which must be a van parking spaces is required and has been provided.)

(Previous Comment: In order to allow the two proposed uses on this parcel of land a total of 27,000 square feet is required for the minimum lot size. This parcel of land is only 16,500 square feet, which sufficient for the residential use only. In order to allow the uses as proposed the property must be rezoned to a minimum of R-3. This plan has been reviewed under the assumption that the owner will either apply for variances or will apply for rezoning of the property.)

SUMMARY: Engineering Division has reviewed the site plan received on 6 May 2003. Approval of the Site Plan is not recommended at this time. The following comment is offered:

SITE PLAN COMMENT:
Roof drainage and runoff conveyance under sidewalk areas has not been fully addressed. Please demonstrate that the north half of the roof drainage will be conveyed under the sidewalk (up to the 10-year storm, minimum), and provide sidewalk scuppers for conveyance under the sidewalk at the eastern two downspouts of the proposed structure (DS 2-08.4.1 E and 3-01.4.4 F).
