SUMMARY: The Grading Plan was reviewed by Development Services Department Engineering Division. The Grading Plan and Stormwater Pollution Prevention Plan (SWPPP) were not approved at this time.
Grading Plan comments:
1. As previously commented, the Development Plan has not yet been approved. The grading plan cannot be approved until the Development Plan has been approved. These comments are based on the latest development plan reviewed by the Engineering Division. Additional comments may be forthcoming once the Development Plan has been approved.
2. Show locations of the roof drains and underground drainage structures as referenced in your response letter. Show that the stormwater from a 10-year event will be not be conveyed over any sidewalk or pedestrian circulation path per City of Tucson Development Standards 2-08.4.1.E.
3. As previously commented, the City of Tucson Department of Transportation (TDOT) may not accept the drainage structure that exits and re-enters the right-of-way since maintenance responsibilities may be unclear. Documentation that TDOT Engineering Division will accept the proposed drainage structures must be provided before the grading plan can be approved.
4. As previously commented, revise the grading plan to show that the thirty-foot natural buffer along Houghton Road must remain undisturbed. Any limited areas that must be disturbed must be revegetated to provide a natural appearance. The grading plan shows a pedestrian path within the natural buffer and key note 14 on pages 2 and 3 indicate that the natural buffer is to be depressed 6 inches. Revise the plan to show only the disturbances that are approved in the Scenic Corridor Zone Review.
5. As previously commented, provide general dimensions for the proposed basins.
6. The developer is responsible for compliance with the Clean Water Act Section 404.
SWPPP Comments:
The Stormwater Pollution Prevention Plan (SWPPP) submitted for the Eckerd Drugstore project does not meet the requirements of the Arizona Department of Environmental Quality (ADEQ) Arizona Pollutant Discharge Elimination System (AzPDES) General Permit for Discharge from Construction Activities to Waters of the United States (General Permit or CGP). Since the response letter to the previous comments referred only to the checklist, this review is based on the submitted plan and the included checklist rather than the previous comments.

1. Clearly identify all operators for the project site, and the areas over which each operator has control. (Part IV.C.1)
2. Indicate in the SWPPP the name of the operator with operational control over project specifications (including the ability to make modifications in specifications). (Part IV.B.2.c)
3. Indicate in the SWPPP the name of the operator with operational control over day-to-day activities at the construction site. (Part IV.B.2.c)
4. Revise the total area of the site and the area of the site to be disturbed to include the off-site areas disturbed for road and right of way improvements and off-site basin construction. (Part IV.C.2.c)
5. Identify on the location map the receiving waters within one mile of the construction site. (Part IV.C.2.e)
6. Revise the site map to show, areas that will not be disturbed including the thirty-foot natural buffer and the areas outside the limits of disturbance around the proposed detention basin. (Part IV.C.3.b)
7. The EPA field inspectors have told us that the SWPPPs should be written to be specific to the project and not general and generic. Revise Sections 2-6 so that all practices are applicable to this project. Provide instructions for implementing all of the identified practices. All listed practices will be considered mandatory and must be shown on the site map as required by the CGP. (Part IV.C.3 and Part IV.D.1)
8. Show, on the site map, locations where stabilization practices are expected to occur. Include interim and permanent stabilization practices. The SWPPP may incorporate other construction related documents by reference. (Part IV.C.3.d and Part IV.G))
9. Specify that when sediment escapes the construction site, offsite accumulations of sediment must be routinely removed and at a frequency sufficient to ensure no adverse effects on water quality. (Part IV.D.2.a and Part IV.D.2.c)
10. Document where any existing vegetation is to be preserved such as within the thirty-foot natural buffer. (Part IV.D.4.a)
11. Section 1.7 states that all of site will be disturbed, section 2.2.2 instructs the operator to preserve vegetation where no construction activity is planned or will occur at a later date, section 2.2.1 calls for scheduling to minimized extended disturbed areas and section 6.1.1 indicates that no more than one half of the site will be denuded at any one time. Provide instructions for implementing these contradictory directives.
12. The operator must maintain the following records as part of the SWPPP. Provide pages or tables to record the required information. (Part IV.D.4.c)
a. Dates when major grading activities occur. (Part IV.D.4.c.i)
b. Dates when construction activities temporarily or permanently cease on a portion of the site. (Part IV.D.4.c.ii)
c. Dates when stabilization measures are initiated and completed and reasons for delay, if applicable, under IV.D.4.b. (Part IV.D.4.c.iii)
13. Describe how all non-stormwater discharges will be eliminated or reduced to the extent feasible. (Part IV.D.7)
14. Describe appropriate BMPs to minimize pollutants in any non-stormwater discharges. Superchlorinated wastewaters must be held on-site until the chlorine dissipates, or otherwise dechlorinated prior to discharge, except if used in emergency firefighting. (Part IV.D.7)
15. Provide clear instructions and details for implementation of each specified BMP. Provide specific scheduling for each practice, relative to major construction activities. For example, describe when the storm drain inlet protection will be installed, relative to the installation of the storm drains. Include installation details for the measures to be installed.
16. Revise the descriptions of the stabilized construction entrance to show that the stabilized construction entrances will be maintained from clearing and grubbing until the vehicle use areas are paved. Include instructions for keeping adjacent paved roads free of dirt that may be tracked onto them. Describe procedures for inspection for tracked sediment and for scheduling cleanup. (Part IV.D.8.b and Part IV.H.4)
17. Describe measures to minimize the generation of dust. (Part IV.D.8.b)
18. Include a copy of the general permit in the SWPPP. (Part IV.F)
19. Include a certification and signature for each operator in accordance with Part VII.K. (Part IV.J.1)
20. Add a note stating that the operator shall report to ADEQ any noncompliance (including spills) which may endanger human health or the environment. The operator shall orally notify the office listed below within 24 hours:

Revise the Grading Plan and the SWPPP to address all of these comments and resubmit two copies of the grading plan and three copies of the SWPPP. Include a copy of the approved Development Plan.
