The following items must be revised or added to the Storm Water Pollution Prevention Plan (SWPPP). Please include a response letter with the next submittal that states how all comments have been addressed.

RESUBMITTAL REQUIRED: STORM WATER POLLUTION PREVENTION PLAN.

1. Each operator is responsible for submitting a completed NOI to ADEQ and to the City of Tucson. Because Entranco will function as the operator with "Operational Control over Construction Plans and Specifications", Entranco is required to submit an NOI.

The following definition is found in Part IX Definitions:

"Operator" for the purpose of this permit and in the context of storm water associated with construction activity, means any person associated with a construction project that meets either of the following two criteria:
1. The person has operational control over construction plans and specifications, including the ability to make modifications to those plans and specifications; or
2. The person has day-to-day operational control of those activities at a project which are necessary to ensure compliance with a SWPPP for the site or other permit conditions (e.g., they are authorized to direct workers at a site to carry out activities required by the SWPPP or comply with other permit conditions). This definition is provided to inform operators of how the regulatory definitions of ''owner or operator'' and ''facility or activity'' are applied to discharges of stormwater associated with construction activity.

Please submit an NOI or revise the SWPPP narrative as necessary.

2. The following was a comment from the first submittal:

Include the following records of stabilization in the narrative:
Dates when major grading activities occur. Part IV.D.4.c.i
Dates when construction temporarily or permanently ceases on a portion of the site. Part IV.D.4.c.ii
Dates when stabilization measures are initiated and completed. Part IV.D.4.c.iii

This comment has not been addressed. The activities listed in section 5 are stormwater controls. The purpose of stabilization records are start and completion dates of construction activity, i.e., grubbing, grading, paving, underground utilities, constructing the building. Revise the SWPPP narrative as necessary.

3. Describe Post Construction Stormwater Controls that will be installed during construction. (i.e. Pipe Outlet) The design and sizing criteria in the SWPPP narrative on page BMP- 70 is not consistent with the pipe outlet detail on sheet 1 of 2 on the grading plan. Revise the SWPPP as necessary. Confirm that the design and installation of the post construction controls are consistent with applicable local (Pima County) requirements. All permits required to construct the drainage structures on Pima County property must be obtained prior to Grading Plan approval. Provide copies of the relevant permits.
