The applicant is authorized to use a portion of the City of Tucson the property described as (legal description):
E320' OF W350' OF N347.02' OF E1923.18' OF NW4, EXC PTN OCCUPIED BY 22ND 2 AC SEC 23-14-14. TAXCODE 131-01-0250.

For the purpose of new construction / tentative improvement only due to fire damage to the existing structure that is within a COT regulatory floodplain.

In reviewing this Floodplain Use Permit Application for an addition to a structure at the subject location, it has been concluded that the proposed improvements are equal to 15 % of the current market value of the structure. The proposed improvements are not subject to the Floodplain and Erosion Hazard Area Regulations. However, when the cumulative improvements equal or exceed 50% of the current market value of the structure no other improvements will be permitted unless the structure is brought into compliance with the City of Tucson Floodplain and Erosion Hazard Area regulations.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed.
Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following conditions shall apply to this permit. (Or refer to Chapter 26 page 35)

1. All work shall conform to the attached plans and documentation which are made part of this permit.

2. This permit is solely for the purpose of tentative improvement due to fire damage to the existing structure.

3. The existing drainage patterns at the property lines shall not be obstructed.

4. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Permit #T02OT01672. For information please call 791-5550."

5. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.

6. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development.


The applicant attest to the fact that the construction plans and documents submitted for the Substantial Improvement/Damage Evaluation are all of the improvements/repairs that will be done to the existing building and that all additions, improvements, or repairs on the subject building are included in the construction plans and documents herewith. No other repairs or reconstruction or additions or remodeling have been made to the subject building that are not included in the attached construction plans and documents.

This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson,
Development Services Department, Engineering Section.
