The applicant is authorized to use a portion of the flood hazard area in the City of Tucson on the property described as:

PALOMINO TRAIL, LOTS 1 THROUGH 26 AND COMMON AREAS "A & B", PORTION OF SECTION 4, T-14-S, R-15-E, G.&S.R.M., for the purpose of installing a fill and grouted rip-rap along the north bank of Magee Wash (see attached plan) in order to develop lots 13-22 as residential lots.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following conditions shall apply to this permit.

1. All work shall conform to the attached plans (Drainage Report/Statement) which are made part of this permit.

2. All proposed fill around the parcel perimeter, which will be less than 100 feet, from adjacent residentially zoned parcels, measured from the subject parcel property line, shall not exceed two feet in height.

3. The proposed fill shall be compacted to a minimum of 95% density, extending only to the extent shown on the attached plan.

4. The Developer shall require a separate Floodplain Use Permit and an Elevation Certificate for every lot (i.e. lots 13-22) when the lot plot plans for each of the said lots are submitted for construction permits.

5. The existing drainage patterns at the property lines shall not be obstructed.

6. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Use Permit No. T02OT01372. For information please call 791-5550."

7. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.

8. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development.

9. Any walls to be constructed within the floodplain will require a separate Floodplain Use Permit, and a separate construction permit.

This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Section.
