Chapter 26 Section 26-4(3) of the Tucson Code states, "any alteration, addition or repair to a nonconforming building or structure which would result in increasing its flood damage potential by fifty (50) percent or more shall be elevated to or above the regulatory flood elevation." Chapter 26 Sec. 26-4.1.(a)(1) of the Tucson Code states, "Any structure which is substantially improved at a cost equal to or exceeding fifty (50) percent of the full cash value of the structure as shown on the latest assessment rolls of the county assessor shall conform to these (floodplain) regulations. For the purpose of determining the value of any such construction, repair, or alteration, the normal retail value of the materials and the reasonable value of labor performed shall be used." The structure is proposed to be substantially improved at a cost exceeding fifty percent of the full cash value of the structure. The finished floor elevation of the original structure and the proposed addition are below the regulatory flood elevation. |
