Conditions for Floodplain Use Permit #T02OT00526 (Cabezon Equestrian Center, proposed stables at 4885 S. Houghton Road):
The applicant is authorized to use a portion of the flood hazard area in the City of Tucson on the property described as (legal Description): A PORTION OF (GLO) LOTS 2, SECTION 36, T14S, R15E, for the purpose of a stable.

The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit.

The following conditions shall apply to this permit.

1. All work shall conform to the attached plans, which is made part of this permit.

2. Any building shall be placed on a engineered pad, compacted to 95% density. The required fill for the pad shall be protected from erosion.

3. Special inspection is required. The lowest finish floor of the buildings in the property under this permit shall be placed upon a dirt, concrete, or similar type solid pad a minimum of 2778 feet above mean sea level, National Geodetic Vertical Datum 1929 (NGVD 1929), as Certified by a Registered Land Surveyor. This certification must be completed and returned to Develop[ment Services Department, the Office of the City Engineer, Engineering Section on the 1st. Floor of the County/City Public Works Building at 201 N. Stone Avenue. This Certification must be completed immediately after the finished floor is constructed. Please call the Development Services Department at 791-5550 or 740-6970 (IVR) for inspection prior to any wall construction.

4. The proposed structure must be setback a minimum of 600 feet from the top of Pantano Wash bank (required 600 feet erosion hazard setback (EHS)). Alternatively, provide an engineering study which shows that the EHS can be reduced due to soil and/or hydrological conditions, or construct an acceptable bank protection to the 100-year floodplain elevation for the Pantano Wash along the bank adjacent to the subject parcel, in order to reduce the required EHS.

5. The existing drainage patterns at the property lines shall not be obstructed.

6. Any proposed perimeter walls will have continuous openings, to the extentof not compromising the structural integrity, at a hight equal to the Base Flood Elevation.

7. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Permit No. T02OT000309 For information please call 791-5550, ext. 195."

8. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties.

9. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development.

This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Section.

Note that final inspection or certificate of occupancy will be on hold until the Elevation Certificate is completed and returned to our office.

The applicant is authorized by the City Engineer to receive a floodplain use permit subject to the above referenced conditions and restrictions.
