The proposed building addition although meets the performance criteria of no openings towards the east side of the building does not meet the minimum building setback for the Daycare Use as required by the underlying zone R-1 adjacent to R-1 with perimeter yard indicator BB. The building setback for the proposed use is more restrictive than the performance criteria and therefore would apply. The minimum building setback required for the underlying zone, is based on the greatest of ten (10) feet or three quarters the height of the building. The minimum building setback based on the proposed 15 feet high building is 11.25 feet. A Lot Development Option for the building setback will be required prior to final approval of the site plan. A copy of the LDO approval letter must be submitted with the final site plan submittal packet. The LDO case number, date of approval, and if applicable, conditions of approval must be listed on the plan. DS 2-02.2.1.A.7 - LUC Section 3.2.6.4 perimeter yard indicator CC adjacent to R-1 Zone requires a minimum building setback of 10' or ¾ the height of the structure whichever is greater. 2. Based on the square footage of the new building (775 square feet), four (4) additional parking spaces must be provided, LUC 3.3.4, Commercial Services Use Group, Day Care land use class. One space per 200 square feet of the gross floor area. The existing use is legal nonconforming for the existing number of parking spaces and vehicular use area. The new parking spaces must meet current code criteria such as size and location. In addition, the spaces may not be placed in a location where the vehicles must back out onto Hedrick Drive. See DS 3-05 for criteria related to the vehicular use areas. (Per the last approved site plan, which was submitted with the Site Plan packet the parking area note indicates that 11 vehicle-parking spaces, were provided. Therefore new vehicle parking spaces have not been provided for the expansion.) A board of adjustment variance to the additional four (4) vehicle-parking spaces for the 775 square feet addition will be required prior to approval of the site plan. The Board of Adjustment case number, date of approval, and conditions of approval must be listed on the site plan. A copy of the Board of Adjustment approval letter must be submitted with the final site plan submittal packet. DS 2-02.2.1.A. - LUC section 3.3.4 Daycare Parking calculation based on 1 space per 200 square feet of the proposed 775 square feet gross floor area expansion requires four parking spaces. 3. Both the Lot Development Option for the building setback variance and the variance for the four (4) additional vehicle-parking spaces may processed through the Board of Adjustment. This site plan may not be approved by the Zoning Review Section until review and approval of the requested LUC variances and applicable expiration of the appeal period.
