COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. Special Exception Land Uses. The proposed land use is not permitted within this zone, unless approved through the special exception approval procedure noted for the Land Use Class, and is subject to any additional conditions listed. The number or letter in quotation marks following the Land Use Class refers to the Development Designator provisions of Sec. 3.2.3. For further information concerning Special Exception Land Use applicability, refer to Sec. 5.3.9. (Ord. No. 8653, ยง1, 2/26/96)

2. The site plan must be drawn based on development standards 2-02. (I acknowledge that the expansion is less than 25 percent in building expansion and that the entire site is not subject to full code compliance.) A complete site plan is required for submittal and review or the last approved site plan that demonstrates compliance with the requirements of development standards 2-02 must be submitted with the partial site plan. The expansion itself is subject to compliance with all LUC and Development Standards criteria that may be applicable. The two following items are major and must be addressed. 1. Cell towers are reviewed through a special exception review process and must be submitted to Glenn Moyer or Aline Torres for review. 2. The expansion must meet the LUC criteria of the Scenic Corridor Overlay Zone. A Scenic Corridor application must be processed for review. See LUC section 2.8.2 for more information regarding the Scenic Corridor Overlay Zone criteria.

The following comments are based on development standards 2-02 and must be addressed on the site plan.

3. Based on the proposed building expansion of 240 square feet, one vehicle parking spaces must be provided on site. If the site has sufficient or excess existing parking spaces that meets the parking requirement for the existing use and the additional parking space required for the expansion, indicate on the plan the location and number of existing parking spaces available. The vehicle parking calculation must reflect required and provided parking spaces. If vehicle parking spaces are not available on the site the required space must meet the requirements for length and width, surfacing materials, and parking lot area requirements as noted in D.S. 3-05.

In addition to the vehicle parking space requirement, two class-two (2) bicycle-parking spaces are required. See D.S. 2-09 for more information regarding bicycle parking facilities criteria such as location, surfacing materials, type of facility, and lighting. Add a bicycle parking calculation to the site plan sheet.

5. Vehicular, bicycle, pedestrian, and handicapped circulation to the new structure must be clearly identified on the plan. The vehicle and bicycle parking spaces must be shown, labeled, and dimensioned. The pedestrian circulation must be clearly defined from the existing structures to the new structure. The pedestrian circulation must also be handicap accessible. Access ramps where required must be shown and labeled. The slope of the ramps must be annotated. See D.S. 2-08 for more information on sidewalk locations, material type, and width.

6. The information related to the proposed waiver requests must be listed on the plan. The requested items for waiver and date of approval of the waivers. AZ copy the approval letter must be submitted with the submittal packet. (Previous Comment: Prior approvals, such as Development Review Board, Lot Development Option, Board of Adjustment, Historic District Advisory Board, and Historical Commission, Special Exception Approvals, COT Code Waiver Approvals, DSMR, etc must be listed on the plan. The case number and conditions of approval must be listed on the plan. The documentation for such approval must be submitted with the site plan.)

9. This site is subject to the criteria of the Scenic Corridor Overlay Zone. A separate Application and review is required for the Scenic Corridor Overlay Zone. Please contact me for the specifics regarding the application and required materials that are required for submittal. A neighborhood meeting is required prior to submittal of the SCZ package.

10. This Zoning Review Section does not review for Special Exception Uses. Glenn Moyer and Aline Torres of the Rezoning Section at DSD handle the Special Exception Review process. Please contact Glenn or Aline at 791-4541 for more information on the Special Exception Use process. The proposed use, Communications; limited to wireless communication towers and antennae is subject to the LUC section 3.4.5.20.B, .C and .E.2 or section 3.4.5.20.B, .C and .G. It is obvious that proposed new use on this site does not meet the requirements of the sections as noted above, especially section LUC 3.4.5.20.C.4. This proposed use (Cell tower) on the site will not meet the requirements of the Scenic Corridor requirements.

11. It is my understanding those Waivers to compliance with the Land Use Code and Development Standards will be sought. If this is the intent, please indicate on the response letter as such. Contact Craig Gross at 791-5608 for information regarding the Waiver Request process. Indicate on the response letter what specific waivers will be sought and revise the plan to meet all remaining code items as required.

04/18/2003 JOE LINVILLE LANDSCAPE REVIEW Denied 1) The project is subject to scenic corridor zone requirements. LUC 2.8.2. Per LUC 3.7.5.2.A "Adjacent to the MS&R right-of-way line, a buffer area thirty (30) feet wide
shall be preserved and maintained in its natural state. In areas where public safety or the delivery of public services precludes preservation of existing vegetation, the buffer area shall be restored as closely to its natural state as possible. No development may occur in a Scenic Route buffer area except as provided in Sec. 3.7.5.2.C."
Based on the section it may be necessary to restore the buffer area if the project includes disturbance of vegetation. Provide a revegetation plan if necessary to comply with the standard. See also DS 9-06.4.1
The comment applies to any and all vegetation within the thirty foot wide buffer area.

2) Disturbance of protected native plants within the right of way along the scenic route will require a native plant preservation plan. Contact Gary Wittwer of the Transportation Department regarding native plant submittal and mitigation requirements within right of way areas. This comment applies to the fiber optic installation. If this requirement has been met, please disregard.
