TRANSMITTAL: November 13, 2002

COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. This site plan was submitted for review of a proposed expansion of dining area for the Merendero restaurant. The site plan does not depict the as built conditions of the site. The plan indicates existing vehicle parking spaces in specific areas for both sites. Per a site inspection conducted by myself, prior to reviewing the plan, it was noted that the parking for the restaurant is not depicted correctly. The parking spaces shown for the auto sales lot are not vehicle parking spaces and the area is being used as a vehicle display area and must be landscaped and screened. The landscaping and screening have not been provided.

The site plan states that the vehicle auto sales lot is also used for miniature golf. Per the site inspection it was clear that there is no miniature golf use on this lot. In addition per a review of the records for this address no approved C of O could be found for the Auto Sales use. Therefore this site has been operated without an approved site plan and C of O. If an approved site plan and C of O for the Auto Sales has been approved recently please provide copies of each.

In discussions with Patricia Gehlen and Craig Gross regarding the existing conditions of the site and the possibility that the future roadway widening of 12th Avenue an expansion will not be allowed as the widening would wipeout the parking area and would leave the site without the required parking.

This plan has been stopped from further review by all other reviewing agencies until such time as the site plan is revised an depicted correctly.
