TRANSMITTAL: Third review December 19, 2002

COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. The site is an existing gas station, offering automotive service and repair, with a storage/repair building added to the north side of the existing station building without permits. This expansion is a greater than 50 percent of the original building, which requires the entire site to be brought into compliance with LUC regulations for motor vehicle and bicycle parking and design, MS&R requirements, pedestrian access provisions, loading space provision, and landscaping, screening and NPPO compliance.

2. Based on the eight (8) repair bays a total of 42 vehicle-parking spaces are required. In addition the design of the parking lot must meet current code requirements, such as 24 feet wide PAALs for two way traffic, angle parking must meet the requirements as specified in the LUC table 3.3.7-I which includes the PAAL width requirement between the cars parked at the pumps and the angle parking spaces.

Of the 22 vehicle parking spaces provided five (5) of the spaces are within the future sight visibility triangles and possibly the future right of way. These spaces will be lost as a result of any future widening of Speedway Boulevard and the required ten feet wide landscape buffer that must be provided entirely on site. The site is deficient in the number of parking spaces required by twenty spaces the widening would result in a total deficiency of twenty-five spaces. A Board of Adjustment variance of twenty-five vehicle parking spaces to LUC section 3.3.4 to permit the existing site to provide a total of twenty-two spaces now and seventeen in the future after the Speedway widening occurs would be required.

3. The width of the PAAL between the building and the parking space as noted in the previous comment must be 24 feet wide. A variance for a 12 PAAL would be required or the PAAL width must be revised to 24 feet. LUC 3.3.7.2 and table 3.3.7-I. (Previous Comment: Clarify how the vehicles are brought into the rear building. It does not appear that sufficient clearance is provided between the southwest corner of the building and the parking spaces along the west side of the parcel. If the vehicles are to be brought via the adjacent parcel PAAL provide a copy of the recorded cross access agreement. Show and label the easement. Add the docket and page numbers and dimension the width of the easement on the site plan. A copy of the cross access agreement must be provided with the next submittal.

4. The requested access ramp detail drawings were not added to the plan depicting how the ramps met code. (Previous Comment: The locations of the accessible ramps have not been depicted on the plan. The minimum slope of the ramp is 1:12. The 1:10 slope is for the flares of the ramp. Add fully dimensioned detail drawings of the proposed ramps that demonstrate compliance. If the ramps are to be typical one detail drawing is sufficient with a note indicating typical. If more than one type of accessible ramp is proposed because of location or space restrictions provide a detail for each specific ramp location and type. The proposed crosswalk along the west side of the canopy does not connect to the pedestrian circulation and ends behind the vehicle bay. This location is unsafe for the pedestrian. Please relocate to the east side of the canopy and connect to the pedestrian circulation. (Previous Comment: All pedestrian sidewalks must be constructed of concrete except at locations where the path crosses a PAAL. Label the sections of the sidewalks that will be constructed of concrete and dimension the width. The minimum width must be four feet. See DS 2-08.4.0 for further information.

The pedestrian circulation path must be accessible for the handicapped. Please demonstrate on the plan how the accessible ramps comply with the I.C.C. section 405. It is not clear on the plan how the ramps have been designed. The slope ratio must be labeled.

5. One 12 feet by 35 feet loading space is required for this use, per LUC section 3.4.5 table 3 section 3.4.5.3, 1,500 sq. ft. to 10,000 sq. ft. buildings. Provide a loading space and demonstrate compliance with maneuverability into and out of the loading space. A board of adjustment variance is required to eliminate the loading space.

7. Please ensure that all changes that are made to the site plan are made to the landscape plan. Also any required changes made to the existing site plan that may affect the future site plan must be addressed.

8. An MS&R covenant will be required to insure that the requirements of the development are met in the future after the roadway widening. The covenant must be recorded with the future site and landscape plans as exhibits. Copies of the recorded documents must be provided with the final submittal of the site plan. A note that states that a future site plan and landscape have been recorded as exhibits to the MS&R covenant must be added to the plan. The docket and page numbers of the recordation must also be added to the note.

9. The information pertaining to the Board of Adjust variances, such as case number, date of approval, conditions of approval must be listed on both existing and future site plans. A copy of the B. of A. letter must accompany the final site plan copies that are to be submitted for stamps and signatures.
