CODE SECTION/ DEVELOPMENT STANDARD

1. a) Clarify whether the building will be setback 12.5 feet from the north lot line or if the setback will be 21 feet from the north lot line as required by code. If the minimum building setback required is not met, an LDO may be applied for. If a variance is applied for you may include the LDO request as part of the variance request. If building size changes, please revise all applicable calculations,
b) Please note whether the canopy is existing or proposed. If existing, provide a copy of the permit for the canopy. If the canopy is proposed, a variance must be applied for since the canopy does not meet the setback to the future curb.

2. Label the existing and future ½ right-of-way and curb locations on the plan as requested in previous comments number seven (7) and nine (9).

4. Previous comments have not been addressed correctly:
a) A sidewalk is required to connect the building and the pedestrian path located along Alvernon Road and Pima Street. Refer to D.S. 2-08.5.1.C for composition of sidewalk.
b) Sidewalks within a project must be physically separated from any vehicular travel lane by means of curbing, grade separation, barriers, railings, or other means, except at crosswalks.

5. Existing and future sign locations may not be located in a sight visibility triangle as described in previous comments. If the existing sign is on a pole, please provide a fully dimensioned elevation drawing to verify height of sign.
a) The site plan indicates an existing sign is located in a sight visibility triangle. Per D.S. 3-01.5.1.A.1, lines of sight may not be obscured between 30 inches and six (6) feet through a triangular area adjacent to a street.
b) If applicable, provide a detail of proposed freestanding signage and outdoor lighting on the site plan.

6. Handicap detail ramps may not be verified for compliance until the pedestrian path has been approved for compliance. Refer to above comment number four (4).

7. Attached is a copy of the City of Tucson Major Streets and Routes Covenant, which must be signed, notarized, and recorded. Please refer to that last sheet of the covenant for additional documents needed for recordation. The covenant must be recorded prior to final site plan approval by the Zoning Review Section.

8. All requested changes must be made to the site and landscape plans.

10/22/2002 JOE LINVILLE LANDSCAPE REVIEW Denied 1. Based on the proposed expansion of floor area, the provisions of the MS&R Setback Zone apply to this site. Provide a plan that shows how the site complies with all LUC requirements when the MS&R right of way area can no longer be used as part of the site. Dimension the MS&R right of way on all plans.

2. The proposed loading zone must be screened from Pima Street with 6' high masonry wall on the future site plan. LUC Table 3.7.2-I

3. The street landscape borders must a minimum of ten feet wide based on the MS&R right of way line. Temporarily the landscape border must be ten feet wide based on the street property line unless the City Engineer approves use of the right of way area for required landscaping. Provide verification of any approval to locate a portion of the 10' wide street landscape border within adjacent right of way areas.

4. A minimum of one canopy tree must be located within the vehicular use area. LUC 3.7.1.2 The tree added to the plans near or within the sidewalk area does not meet the requirement.

5. Show all plants indicated in the calculation on the planting plans DS 2-07.2.2.

6. The project has not been approved for Native Plant Preservation. Additional revisions to the landscape plan may be necessary in order comply with regulations. LUC 3.8
10/23/2002 JOE LINVILLE NPPO REVIEW Denied The previous comments regarding Native Plant Presrevation have not been addressed.

The plans will not be accepted for review without a native plant preservation plan or approved exception.

The NPPO application for exception is denied. The application form is not complete. In addition the pictures submitted show a number of protected native plants. LUC 3.8
