02/28/2002 DAVID RIVERA ZONING REVIEW Denied Per a conversation with Carol Kulman on February 28, 2002 regarding one zoning issue I made a change to the plan with her permision. The change was to correct the dimension of one of the two parallel parking spaces from 18 feet to the required 23 feet. The parallel parking spaces are located along the north side of the residence. The parallel spaces must be 23 feet in length not 18. I have made the changes to the bluelines but if addional changes are required as a result of comments by other reviewing agencies, please make the change to the parking space on the new copies and resubmit.

I am also providing to Carol Kuhlman via Email, copies of the PDF files for the MS&R and Lot combo covenants which must be recorded and copies of the recorded documents submitted to the DSC section requesting the documents. (Zoning, Landscaping or Engineering)

1. Prior to final approval of the site plan, An approved future site plan and landscape plan is required indicating how the project will comply with LUC requirements when the MS&R right-of-way can no longer be used as part of the site. Such plans are to be an exhibit to an executed Covenant for recordation stating the responsibility of the property owner, successor, or assignee as to the removal of improvements and compliance with the LUC at no cost to the City. The plan sheets that must be included as the exhibit to the covenant are sheets A0.1 and L2. You must contact the Recorders office for plan sheet size when used as exhibits to a recorded covenant. Please provide a copy of the recorded covenant and exhibit with the next submittal.

The future site plan included with the latest plans submittal package appears to meet LUC requirements and or criteria as it applies to the Zoning Review Section responsibilities. The site plan and future site plan will not be stamped by the Zoning Review Section until all reviewing agencies have had an opportunity to review the plans for compliance as it pertains to their specific criteria. If changes are required to be made to the plans please resubmit revised copies.

(The existing Beauty Salon structure will not have the required minimum 21' building setback from the future back of curb. Although the setback as noted above would not meet the requirement the structure will become legal nonconforming.)

2. Please review and address all Zoning, Engineering, Landscape, ADA, and Fire reviewer comments prior to submitting the final copies of the proposed site/landscape plans and future site/ landscape plans.

3. Upon approval of the future site and lanscape plans the MS&R covenant and the exhibits may recorded. A hold on the permits will be placed until such time as copies of the recorded covenant and exhibits documents are provided to the DSD Zoning, Landscape and Engineering sections.
