A Board of adjustment variance will be required for the two (2) accessory structures (Location #3 as noted on the plans) that are located within the R-3 zone. Per LUC sections 3.2.5.3.B and .C, Specifically Within Residential Zones. The structures used for an accessory use within a residential zone shall comply with the following. B. Accessory structures shall not exceed twelve (12) feet in height, unless attached to a principal structure. If attached to the principal structure, maximum height permitted is the same as for the principal structure. C. Detached accessory structures are not allowed in the buildable area extending the full width of the lot between the principal structure and the front street lot line, except for terraces and steps not over three (3) feet high above the natural grade, paved areas, and fences or walls. DS 2-02 2. Typically a Lot Development Option would be in order for Arbor locations #1 and # 4. The building setbacks for both arbors must be based on greater of 21' or the height of the structure from the back of the future curb location, LUC section 3.2.6.5 table 3.3.6-I ADT of 1000 or greater. The arbors as shown on the plan do not meet the minimum 21 (21) foot building setback from the existing back of curb location. The request for Arbor locations #1 and #4 to be built as shown on the plan should be included in the Board of Adjustment variance request; in addition the proposed arbors will be in the future right-of-way. Recorded covenants stating that the arbors (if variances are granted and the arbors allowed to be constructed as shown on the plan) will be removed at the time of the Valencia Road widening, and will be removed at no expense to the City of Tucson. 2. Please revise the plans to correctly depict the future property line, curb, and sidewalk. Dimension the existing and future right-of-way as well as the existing and future curb locations. I have redlined sheet G-2 for your convenience and reference. Revise plan sheets G-2, AS1, and AS3 as required. The construction centerline of Valencia Road must be used as the reference point for future widening. The section line is not the construction centerline. See attached copies of the existing Valencia Road paving plans for reference. The zoning boundary line must be depicted and the zoning classifications must be added on sheet G-2. I have added the zoning classifications and drawn in the zoning boundary line in blue per the dimensions on the zoning map provided. 4. Per Bill Balak, Principal Planner with the Planning Department, it was requested that a letter to Walter Tellez, Planning Department Zoning Administrator explaining the scope of work and the variances that are to be requested be submitted for review. A drawing, which shows the proposed construction, should be included as reference with the letter. For further information on the Board of Adjustment process or the letter as requested contact Wayne Bogdan, Bill Balak or Walter Tellez at 791-4541. 5. The Board of Adjustment case number, variance requests, and conditions of approval must be added to the plan prior to approval by the Zoning Review Section. Provide a copy of the Board of Adjustment approval letter to the Zoning Review Section with site plan submittal. |
