This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-07. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

General Comment: The following comments are pending issuance of DP19-0196. The final plat will not be approved until DP19-0196 has been issued.
2-07.5.0 CONTENT REQUIREMENTS

2-07.5.1.D Place the words "SEQ#________" in both the upper and lower right corners outside the margin line. The blanks will be completed by the Pima County Recorder's Office at the time of recordation.

1. COMMENT: Correct the "SEQ." on the plat to read "SEQ#".

2-07.5.2.C Provide the following notes:
"Total miles of new public streets are ____.
"Total miles of new private streets are ____."

2. COMMENT: DP19-0196, general note 21, indicates a total of 0.29 miles and the Final Plat, general note 4, indicates a total of 0.268 miles. Verify the total miles of new public streets.

3. COMMENT: 2-07.5.3 Standard Paragraphs
All signatures must be in permanent, black, India ink and be accompanied by a notary signature and seal.

2-07.5.3.A Certification of Survey
The following statement must be signed by a registered land surveyor and placed on the first page:

CERTIFICATION OF SURVEY

"I hereby certify that the boundary survey as shown on this plat was performed under my direction and that all existing or proposed survey monuments and markers shown are correctly described. I further certify that this plat was prepared under my direction."

4. COMMENT: Revise the language in the "Certification of Survey" block to read as follows, "I hereby certify that the boundary survey as shown on this plat was performed under my direction and that all existing or proposed survey monuments and markers shown are correctly described. I further certify that this plat was prepared under my direction." Ensure that on the final mylar the surveyors stamp does not indicate "preliminary".


2-07.5.3.B Dedications

The following statements are required on the first page of the plat. These statements indicate that all streets, alleys, easements, and other rights-of-way and any lands for public uses are dedicated by the plat to the public or for private use. The paragraph entitled DEDICATIONS consists of four elements: a statement of certification of title; a dedication statement; a hold harmless clause; and a signature line(s) for the property owner(s). The paragraphs may be amended to fit the applicable situation.

2-07.5.3.B.1 Certification of Title.

"(I/We), the undersigned, hereby warrant that (I am/we are) the owner(s) and the only (party/parties) having any interest in the land shown on this plat, and (I/we) consent to the subdivision of said land in the manner shown hereon."

5. COMMENT: In the Dedication Block, revise the language to include "owners". For example, "We, the undersigned, hereby warrant that we are the owners…".




2-07.5.3.B.2.a "(I/We) hereby dedicate and convey to the public forever all rights-of-way as shown hereon, including all streets, roads, parks, easements, and drainage ways."

6. COMMENT: Revise the language in paragraph five of the Dedication block to the above language.

2-07.5.3.B.2.d "Private streets, drainage ways, and common areas shown on this plat are reserved for the private use and convenience of all owners of property within this subdivision, and easements are granted to the public and all utility companies together with access for the installation, maintenance, and improvements of aboveground and underground utilities, public sewers, and drainage. Title to the land of all private streets, drainage ways, and common areas will be vested in an association of individual lot owners as established by Covenants, Conditions, and Restrictions recorded in Sequence #________ in the Pima County Recorder's Office. The association will accept responsibility for control, maintenance, and liability for the private streets, drainage ways, private sewers, and common areas within this subdivision."

7. COMMENT: Revise the language in paragraph four of the Dedication block to state the above required language. It appears that paragraph four and six in the Dedication block split the above required language into two paragraphs.


2-07.5.3.C If applicable, the following BENEFICIARY block must be included on the title page.

8. COMMENT: Revise the Beneficiary block to include the Title Company name, Title Security Agency, LLC and the applicable trust number. See below for sample language.
