COMMENTS: 1. The title block in the lower right hand corner, mentions the incorrect map & plat of 'bk 05, pg. 55' as the resubdivision information. 11/21/2019 | DAVID RIVERA | ZONING | REVIEW | Reqs Change | CDRC TRANSMITTAL TO: Development Services Department Plans Coordination Office FROM: David Rivera PDSD Zoning Review Section PROJECT: 18 W. 18th Street - Residential Development Single Family Attached (GIID Overlay) Final Plat (1st Review) - 18 W. 18th Street S19-079 - C-3 Zoning TRANSMITTAL DATE: November 21, 2019 DUE DATE: December 9, 2019 COMMENTS: Please resubmit revised drawings along a detailed response letter, which states how all Zoning Review Section comments were addressed. This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-07. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM). Final plats, block plats, minor subdivisions, and condominium plats shall be prepared according to the requirements provided below. Hereafter referred to as "plat" or "plats." A final plat serves as a survey document suitable for recordation of all or part of an approved tentative plat, if applicable. The final plat must conform to the approved tentative plat or site plan in lot configuration, design, and required conditions of development. The final plat, once approved, is recorded in the Pima County Recorder's Office. The final plat is kept on file and becomes part of the permanent record for the subject site. (Am. Admin. Directive, 5/14/2013) 2-07.3.0 SUBMITTAL TIMING Review of final plats is normally initiated after the tentative plat has been approved, unless concurrent tentative and final plat submittal has been approved by the PDSD prior to submittal. Final plats may also be submitted for review prior to the approval of a tentative if a minimum of one review of the tentative plat have occurred. In any case, submittal of the final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat. 1. COMMENT: 2-07.5.1.E - The information listed in the title block of the final plat appears to be different than what was listed in the title block of the TP. It will be assumed that the information listed on the final plat will replace the information listed in the title block of the TP. 2. COMMENT: 2-07.5.1.H - List the subdivision case number S19-079 next to the title block of both sheets. List as reference the TP case number DP18-0283 next to the title block of both sheets. 3. 12/03/2019 | SBEASLE1 | OTHER AGENCIES | TUCSON AIRPORT AUTHORITY | Reqs Change | December 3, 2019 RE: S19-079 / 18 W. 18th St., Final Plat / 1st Submittal, Received November 7, 2019 Thank you for the opportunity to comment on S19-079, 18 W. 18th St., Final Plat; 1st Submittal, a development package application of a final plat for an approximately 0.59 acre site, located northeast of the intersection of South 7th Avenue and East 18th Street. The property is zoned Commercial 3 (C-3), with the proposed development being residential townhomes and an alcoholic beverage sales use. This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace. The Tucson Airport Authority conditionally approves the subject request contingent upon the following condition of approval, as noted below. This condition shall be identified in the general notes of the revised development plan. Condition of approval: 1. "According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. The project applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp" Although this project does not propose a change in plan designation or zoning the Tucson Airport Authority highly recommends the applicant add the following two notes into the general notes of the revised development plan. This project is located approximately 5 ½ miles northwest of Tucson International Airport and is within FAA traffic pattern airspace, an area which would be subject to aircraft overflight and noise due to being in close proximity to Tucson International Airport. The first proposed note would provide a means of assuring that future owners and tenants of the property are aware they are in proximity an airport and further assures the continued right of the City of Tucson, Tucson Airport Authority, and all persons lawfully utilizing the Tucson International Airport the right to utilize the airspace above or near the property. This would be accomplished through the property owner recording the Avigation Easement. The second proposed note is meant to be a second method of notification, but only for residential related uses, that future property owners and tenants are living near an airport. The Tucson Airport Authority believes the proposed notes help to support the City of Tucson Airport Environs Overlay Zone and supports Plan Tucson - Regional and Global Positioning policy 4 (RG-4). 1. "That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided. The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a complete copy of the recorded easement document to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below. Scott Robidoux, Senior Airport Planner Tucson Airport Authority, 7250 South Tucson Boulevard Suite 300, Tucson, AZ 85756" 2. "For only residential uses - The developer shall provide the Airport Disclosure Statement form, at time of sale, to the new property owners with new unit purchases. In the event the development of any residential uses does not involve the sale of new units, but is instead offering rental residential units to the public, the new tenant of the rental unit shall be provided a copy of the Airport Disclosure Statement form. The intent of the Airport Disclosure Statement form is to educate and notify the new residents that they are living near an airport. The content of such documents shall be according to the form and instructions provided. The new property owner or new tenant shall forward a signed copy of the Airport Disclosure Statement form to the Tucson Airport Authority, using the mailing address provided below. Scott Robidoux, Senior Airport Planner Tucson Airport Authority, 7250 South Tucson Boulevard Suite 300, Tucson, AZ 85756" Please do not hesitate to contact me if you have any questions or concerns regarding this comment letter.
