Thank you for the opportunity to comment on S19-071, Littletown and Craycroft, Lots 1-3; 1st Submittal, a development package application of a final plat for an approximately 8.05 acre site, located southwest of the intersection of East Littletown Road and South Craycroft Road. The property is current zoned Residence Zone 1 (R-1) and is currently proposed to be rezoned to Commerical Zone 1 (C-1) under City of Tucson Rezoning case C9-19-04. The rezoning case identified the proposed development on this property was intended to be commercial uses.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. The below conditions were identified as Condition 11 and 12 of the Zoning Examiner's Conditions for the rezoning of this property under City of Tucson Rezoning case C9-19-04. The Tucson Airport Authority has included these same rezoning conditions, within the Conditions of Approval below, and requests the applicant revise the general notes of the development plan to include the below Conditions of Approval to aid in complying with the rezoning conditions.
Conditions of Approval:
1. "According to the Federal Aviation Administration (FAA) Notice Criteria Tool, this project area is located in proximity to a navigation facility and could impact navigation signal reception. As the project site develops every project applicant shall file FAA Form 7460 with the FAA at least 45 days before construction activities begin for every proposed project unless FAA staff, with the Obstruction Evaluation / Airport Airspace Analysis (OE/AAA), provides the project applicant with written communication that filing FAA Form 7460 is not required. It is highly recommended that the applicant file earlier than 45 days to provide the applicant with sufficient time to respond to any concerns which are identified by the FAA. Any cranes which are used must also be identified with Form 7460. Please file Form 7460 at https://oeaaa.faa.gov/oeaaa/external/portal.jsp"
2. " Prior to the City's approval of this rezoning request, the property owner shall record the Avigation Easement which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The Avigation Easement shall be recorded in a manner with the Pima County recorder which shall document it as having title liability. The content of such documents shall be according to the form and instructions provided."
The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a copy of the recorded easement to the Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-07. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

Final plats, block plats, minor subdivisions, and condominium plats shall be prepared according to the requirements provided below. Hereafter referred to as "plat" or "plats." A final plat serves as a survey document suitable for recordation of all or part of an approved tentative plat, if applicable. The final plat must conform to the approved tentative plat or site plan in lot configuration, design, and required conditions of development. The final plat, once approved, is recorded in the Pima County Recorder's Office. The final plat is kept on file and becomes part of the permanent record for the subject site. (Am. Admin. 2-07.3.0 SUBMITTAL TIMING
Review of final plats is normally initiated after the tentative plat has been approved, unless concurrent tentative and final plat submittal has been approved by the PDSD prior to submittal. Final plats may also be submitted for review prior to the approval of a tentative if a minimum of one review of the tentative plat have occurred. In any case, submittal of the final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat.

2-07.4.0 FORMAT REQUIREMENTS
Plats must:
4.1 Be on a 24-inch by 36-inch sheet(s) folded to the eight and one-half inch by 11-inch format shown in Exhibit I. The plat may comprise several sheets showing various elements of required data;
4.2 Be prepared on materials that can be transferred to double-matt Mylar reverse read;
4.3 Have a two-inch margin on the left side and one-half inch margins on the remaining sides to comply with standardization requirements of state law for recorded plats;
4.4 Be drawn to a scale of no more than one inch equals 40 feet; and,
4.5 All lettering and dimensions shall be three-thirty-seconds inch in height.

2-07.5.0 CONTENT REQUIREMENTS

5.1 General



2-07.5.1.A.3 Subdivisions, arterial and collector streets, major watercourses, and railroads within the one-mile area; and,

2-07.5.1.H - The Subdivision Case number assigned to the final plat and the DP case number assigned to the approved tentative plat must be placed in the lower right corner of the plat next to the title block. If the property is subject to a rezoning case, the C9-__-__ rezoning case number is to be noted also.

2. COMMENT: Provide the Subdivision case number S19-071,



2-07.5.2.I If the subdivision was the result of a rezoning case and did not require submittal and review of a tentative plat, add the following note: "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public."

2. Original set of executed and notarized (permanent, black ink only) Final Plat on double matte océ or photo mylar. Fill in blank for 'filed at the request of ____'.

3. Title report current within the last thirty (30) days or statement from Title Company certifying the title report previously submitted is still valid.

4. Check or money order made payable to "Pima County Recorder" in the amount of: $20.00 per plat page plus a flat $4.00 handling fee, along with flat $30.00 fee per document for Consent to Dedicate and CC&R (if applicable). The City pays to record the Assurance Agreement. If you are unsure of the fees, please call the County Recorder's Office at 520-740-4350. Check must be pre-printed with name and address and dated within 45 days of the scheduled Mayor & Council meeting.

5. Original set of executed and notarized CC&R (if applicable).

6. Original set of executed and notarized Assurance Agreement (if applicable). For Third Party Land Trust, provide original Agreement to Construct, original Amendment to Trust, and copy of Trust Agreement.

7. Property owner(s) and consultant mailing addresses to receive notification one (1) week prior to and following the Mayor & Council meeting.

8. Upload a PDF scan of executed Plat, CC&R (if applicable), Assurance Agreement (if applicable), and title report to www.tucsonaz.gov/file-upload-pdsd.

The Final Plat, CC&R, and Assurance Agreement must be approved at the same Mayor & Council meeting. The City Development Review Committee ensures the Assurance Agreement is reviewed by the City Attorney's Office prior to the Mayor & Council meeting. The recorded CC&R will be mailed to the address on the cover sheet. The City Clerk's Office keeps the recorded Final Plat and Assurance Agreement. A copy of the recorded Final Plat and Assurance Agreement will be available on www.tucsonaz.gov/pro.
