COMMENTS: the following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1).


This site is located in the RX-2 zone (UDC 4.7.7). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-1). See Use-Specific Standards 4.9.7.6.

The minimum setback is twenty feet facing each interior property line (Table 6.3-1.A).

The owner and adjacent owner have entered into an agreement to do a lot reconfiguration. The existing lot line is to be reconfigured as depicted on the survey drawing and will create a non-compliant building setback along the new (north) property line. The minimum perimeter yard setback in an RX-2 Zone is 20 feet flat.

(The owner of the property has an approved building permitT17CM06709 for the new residence based on the configuration of the existing lots. Unfortunately because the owner does not have direct frontage to the street the water department will not provide the owner with a water meter. Therefore the lot split is being processed as a flag lot providing direct access to Royal Copeland Dr.)

Based on the new lot line the new residence will not meet the required building setback of 20 feet, the applicant is requesting a modification of the required 20 foot building to 12 feet.
