Dear Ms. Lee,

Thank you for the opportunity to comment on DP18-004, Final Plat La Estancia de Tucson, Lots 665-828; 1st Submittal, a final plat application for an approximately 21 acre site, the project area is located northeast of the intersection of Los Reales Road and South Wilmot Road. The proposed land use is residential; establishing single family homes.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area and FAA traffic pattern airspace.

The Tucson Airport Authority provided comments on a previous submittal, DP17-0254, comment letter dated 11/20/17, which is identified as being associated with S18-004.

The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions should be identified in the general notes of the approved development plan.

Conditions of approval:

"That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement prior to the subdivision process which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The content of such documents shall be according to the form and instructions provided."

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a copy of the recorded easement to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

"The developer shall provide the Airport Disclosure Statement form, at time of sale, to the new property owners with new unit purchases. In the event this proposed project does not involve the sale of new units, but is instead offering rental residential units to the public, the new tenant of the rental unit shall be provided a copy of the Airport Disclosure Statement form. The intent of the Airport Disclosure Statement form is to educate and notify the new residents that they are living near an airport."

1. COMMENT: Label the Julian Wash (major watercourse) on the project location map.

2-07.5.1.C If the project is located within the boundaries of a Planned Area Development (PAD) zone, include a reduced-scale map of the entire PAD on the first sheet, indicating the location of the portion being developed.

2. COMMENT: The reduced scale map does not show the entire PAD. Please correct.

2-07.5.1.E. Provide a title block in the lower right corner of each sheet

3. COMMENT: Please make the tentative plat and block plat title block consistent with eachother.

2-07.5.1.H The DP case number for assigned to the approved tentative plat must be placed in the lower right corner of the plat next to the title block. If the property is subject to a rezoning case, the C9-__-__ rezoning case number is to be noted also.

4. COMMENT: What is the SP number? Please confirm this is for PAD-7.

2-07.5.1.I A legend which shows and describes all symbols used on the drawing must be placed on either the first sheet of the plat or the first sheet which contains all or part of the subdivision drawing.

5. COMMENT: Please identify the meaning of the asterisks next to lot number: 828

2-07.5.2.D If the property is subject to conditions of rezoning, add the following note: "This plat is subject to the conditions of rezoning case number C9-__-__, unless superseded by a subsequent rezoning ordinance."

6. COMMENT: Add the ordinance number to note 6 and remove reference to City of Tucson Land Use Code and replace with Unified Development Code.

7. COMMENT: please identify reference to Development Regulations III.A.1Se2. I could not find that section in the Planned Area Development.

8. COMMENT: Please remove reference to rezoning for Van Horne Elementary C9-16-03.

9. COMMENT: Please remove reference to Land use Code in note 10. Replace with Unified Development Code.

2-07.5.4.C. If the project has common areas, label each common area individually with a separate letter designation. Enclose with a solid line each common area, private street, etc., that will have separate restrictions, a separate homeowners' association, or any common area that is separated by a public right-of-way;
