This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-07. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).


2-07.5.1.H The DP case number for assigned to the approved tentative plat must be placed in the lower right corner of the plat next to the title block. If the property is subject to a rezoning case, the C9-__-__ rezoning case number is to be noted also.

1. COMMENT: This final plat has been assigned the case number S17-072. List the case number in the lower right corner next to the title block. If there was a submittal of a DP / TP list assigned case number as reference also in the lower right corner next to the title block.


2-07.5.3.B.3 Add the following hold-harmless statement: "(I/We), the undersigned, do hereby hold harmless the City of Tucson, its successors and assigns, their employees, officers, and agents from any and all claims for damages related to the use of the property depicted on this plat now and in the future by reason of flooding, flowage, erosion, or damage caused by water, whether surface flood or rainfall."

2-07.5.3.E Assurances
The following ASSURANCE block must be placed on the plat's first sheet.

"This is to certify that all improvements, such as streets, sidewalks, sewers, water and utility installation, drainage and flood control facilities, and monuments, required by the City of Tucson have been completed or the future completion of such improvements has been assured by a land trust financial assurance agreement, the posting of performance bonds, an escrow account, letter of credit, or other security as the City of Tucson deems necessary and proper. Thank you for the opportunity to comment on S17-072, CPLC Irvington Expansion; 1st Submittal, a development package application for a final plat of an approximately 3.95 acre site, the project area is located southwest of the intersection of West Irvington Road and South Liberty Avenue. The proposed zoning is commercial, office, and residential; establishing a long term residential care services use and a medical outpatient use, with it being anticipated that individuals would be utilizing this residential use for more than one year.

This site is within the Tucson International Airport avigation easement requirements and public disclosure area, FAA traffic pattern airspace, and FAA Part 77 airspace.

According to the FAA Notice Criteria Tool, this project is located in proximity to a navigation facility and could impact navigation signal reception. The applicant shall file Form 7460 with the FAA at least 45 days before construction activities begin for the project. Any cranes used which are used must also be identified with Form 7460. The Tucson Airport Authority conditionally approves the subject request contingent upon the following conditions of approval, as noted below. These conditions should be identified in the general notes of the approved development plan.

Conditions of approval:

"That prior to the City's approval of any construction permit for a permanent building, the property owner shall record the Avigation Easement prior to the subdivision process which discloses the existence, and operational characteristics of the Tucson International Airport to future owners or tenants of the property and further conveys the right to the public to lawfully use the airspace above the property. The content of such documents shall be according to the form and instructions provided."

The current property owner or person authorized to sign on behalf of the current property owner shall complete, sign, and record the Avigation Easement. Please record the Avigation Easement with the Pima County Recorder's Office. Once the Avigation Easement is recorded please send a copy of the recorded easement to Tucson Airport Authority by either email (send to srobidoux@flytucson.com) or to the mailing address provided below.

The following comments are only applicable to the development of any residential uses for this project. The applicant has identified that the residential use will be a Residential Care Service which will provide care to individuals for periods of time greater than one year. Due to the period of time the individuals could be residing within the residential use, the operator of the residential use shall provide the Airport Disclosure Statement form to the individual engaging in the usage of this residential use. The intent of the Airport Disclosure Statement form is to educate and notify the residents that they are living near an airport.
