COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Unified Development Code and Development Standards were addressed.

This plan has been reviewed for compliance with the Administrative Manual Standards listed in section 2-07 of the City of Tucson Administrative Manual. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC).

The review comments include the actual standard first with the applicable Administrative Manual section number and the following paragraph is the actual comment related to the specific item that must be addressed.

1. Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site Final Plat that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A Final Plat application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is July 7, 2016.

2-07.5.1.H - The S(Year)-___ subdivision case number assigned to the approved tentative plat must be placed in the lower right corner of the plat next to the title block. If the property is subject to a rezoning case, the C9-__-__ rezoning case number is to be noted also.
01. COMMENT: This project has been assigned the PDSD case number S15-026. List the case number in the lower right corner of all plan sheets.

2-07.5.4 Proposed Subdivision Information
Provide the following information on the plat:
2-07.5.4.H - Show no-vehicular access easements where applicable;
02. COMMENT: If applicable, indicate on the plan the locations where the no-vehicular access easements are proposed.

2-07.5.6 Protective Covenants
Protective covenants or Covenants, Conditions, and Restrictions (CC&Rs) establishing responsibility for construction, maintenance, and ownership of any proposed common area, open space, private street, or similar joint use, when needed, will:
A. Provide for maintenance of and liability for any proposed commonly-owned areas; and
B. Include the various conditions of rezoning or other special situations requiring permanent administration by an owners' association.
03. COMMENT:
On sheet one of the CC&R's the Common Areas have not been correctly identified. Revise the Section A to include all common area labels A, B, C, etc.

Zoning could not verify if there is a term limit for the CC&R's, i.e. 20, 25, 30 years? Section 15.1 is not clear. If the information is in another section of the CC&R's clarify. Respond with the section number in your response comments.

Tucson Electric Power Co. (TEP) has reviewed the Final Plat submitted July 8, 2015, and is unable to approve the plat at this time. A preliminary electrical design must be completed and easements for TEP facilities shown on the plat for TEP approval. There is an existing overhead electrical line located within the boundary of the subdivision. The developer is responsible for all costs associated with the removal or relocation of the existing facilities.


In order for TEP to prepare an electrical design for this subdivision, please email a copy of the Approved Tentative Plat and the subdivision AutoCAD file, including water plans, to fmendez@tep.com

The Final Plat for the proposed project has been reviewed on behalf of Pima County Regional Wastewater Reclamation Department (PCRWRD).
RWRD is requesting additional information for the above referenced submittal of the Final Plat as received on July 7, 2015. The following revisions are requested:

1. Sheet one: Revise the Dedication. Per Eng2015-01 private streets with public sewer must use the following language:

Grantor hereby irrevocably grants and dedicates easements to Pima County for access, installation, construction, maintenance and replacement of public sewer systems in all common areas "A" - "C" designated by this plat; or

Grantor hereby irrevocably grants and dedicates easements to the respective utility providers for access, installation, construction, maintenance and replacement of underground utilities and public sewer systems in all common areas "A" - "C" designated by this plat.

2. Identify the purpose for Common Areas "A" - "D".

3. Submitted plans must be sealed and signed by the Engineer of Record. If plans are not at the stage to be submitted as above then plans must be identified as "Preliminary - not for recording".

4. Provide the "Trust Number information" for Title Security Agency, Inc.

The following items need to be addressed:

FINAL PLAT COMMENTS:

1) AM Sec.2-07.4.3: Revise the Final Plat to have a one-half inch margin on all sides (with the exception of the two-inch margin in the left side) to comply with standardization requirements of state law for recorded plat.

2) AM Sec.2-07.5.1.E.1: Revise the Final Plat and Title Block to accurately describe all proposed Common Areas "A-D" as shown on Sheet 2. Since the proposed subdivision is a Flexible Lot Development it shall be noted in the Title Block.

3) AM Sec.2-07.5.1.H: Revise the Final Plat to place the assigned subdivision case number "S15-026" in the lower right corner of the plat next to the Title Block on all sheets.

4) AM Sec.2-07.5.3.C: Revise the Final Plat to include the Trust Number under the Dedication and Beneficiary of Trust Sections.

5) AM Sec.2-07.5.3.D: Verify that the Mylar when submitted has the "Filed for Record at the Request of…" completed under the Approval Section. This must be filled in prior to scheduling the Plat for Mayor and Council consideration.

6) AM Sec.2-07.5.4.A: Revise the Final Plat to indicate the required future right-of-way dedication notation for Park Avenue. Since the associated development plan package is being prepared in conjunction with a subdivision plat street dedication in accordance with the Major Streets & Routes Plan is required for Park Avenue.

7) AM Sec.2-07.5.4.H: Revise the Final Plat to show no-vehicular access easements where applicable.

8) AM Sec.2-07.5.5.C.1: Revise the Final Plat to provide a Basis of Bearing Statement. The basis of bearings must be established from at least two found, physically monumented points described and shown on the final plat. If the monuments at each end of the reference line are fully described on the plat, they need not be described in the "Basis of Bearings" statement.

9) AM Sec.2-07.5.5.C.5: Revise the Final Plat to indicate whether the distance between all monuments are measured or calculated.

10) AM Sec.2-07.5.6: Revise the CC&Rs to accurately describe the property per the Title Block on the Final Plat, specifically describe the Common Areas in the first paragraph of the CC&Rs to match the Title Block with exact wording.

11) AM Sec.2-07.5.6: Revise the CC&Rs to fill in the Trust Number and all blanks throughout the document.

12) AM Sec.2-07.5.6: A signed and original notarized copy of the Declaration of Covenants, Conditions, Restrictions, and Easements will be required prior to Final Plat Mylar approval.

13) AM Sec.2-07.6.1.B: The final plat cannot be scheduled for Mayor and Council consideration until either Financial Assurances are submitted or a copy of a performance bond for the project is submitted and approved. It is recommended that the Assurance be provided for review as soon as possible to help facilitate the Mylar submittal.

14) AM Sec.2-07.6.1.E: Submit two copies of an updated title report (current within 30 days) at Mylar submittal. A statement from the title company certifying the title report previously submitted is still valid is acceptable in place of an additional title report. The Title Report submitted has an effective date of May 15, 2015 which does not meet the 30 day requirement.

GENERAL COMMENTS:

Provide a revised Final Plat, CC&Rs, and Financial Assurances at re-submittal addressing the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Dear Ms. Gehlen:

Southwest Gas Corporation (SWG) has no objection to the development of the above-mentioned project. Existing natural gas facilities are located in adjacent rights-of-way and in the area of development and may be affected by construction of this project; specifically, existing 2”- 4” gas mains are located within the rights-of-way of Blacklidge Drive, Hedrick Drive, Park Avenue, and Tyndall Avenue and in addition, several existing 1/2” gas services are located within the property directly north of this project.

Blue Stake and potholing are suggested for best accuracy when locating SWG facilities. Please be aware that SWG requires a minimum one-foot separation from distribution facilities and any proposed structures and two-foot separation from high pressure gas facilities. SWG requests the contractor use caution when working in the vicinity of gas facilities and protect and support gas facilities per Blue Stake requirements.

SWG also requests that no trees be planted within close proximity to gas facilities due to root intrusion; therefore, SWG requires all tree placements have a minimum eight-foot clearance from the tree center line to existing or proposed gas facilities. Shrubs and bushes may be planted within the eight-foot clearance zone.

All information is provided for reference use only. Please note that it is the responsibility of excavators or those developers planning excavation to verify actual field conditions in advance of construction so that requests for gas service or any potential issues can be addressed in a timely manner, including payment for conflict mitigation if applicable.
