Costs for removal or relocation of existing electrical facilities, if required, will be billable to the developer. Easements required for new development within the platted area will be obtained by separate instrument.

Please call the New Construction Department at 520-918-8300 to apply for service. Submit a final set of approved plans including electrical load and offsite improvement plans to determine how TEP will serve this development. If easements are required, they will be obtained by separate instrument.

SUBJECT: Rio Verde Village Block Plat Engineering Resubmittal Review

SUMMARY: This project site is susceptible to erosion and an erosion protection wall has been proposed near portions of the Tanque Verde embankment. In lieu of a Tentative Plat submittal, a comprehensive drainage report was to be provided that clearly addresses the floodplain and erosion hazards for the project, including technical engineering justification and erosion hazard calculations per Tucson Code, and as discussed with PDSD Engineering/Floodplain Administrator. This review of the Block Plat does not provide approval of any improvements within parcel 109-22-020S. PDSD Engineering has reviewed block plat submittal for Rio Verde and provided the Engineering consultants 19OCT15 preliminary comments that were remaining and also went over the comments in a meeting on 20OCT15. PDSD Engineering does not recommend approval at this time until the remaining plat comments are addressed. Note: these comments may need to be revised based on further discussion due to last minute meetings with Developer and Engineering consultant.
FINAL PLAT GENERAL NOTES AND SURVEY RELATED COMMENTS:
1) UDC Sec.8.4.1.E.3, Admin Man Sec.2-07.5.4.A: Assure that all easements / entities are clearly drawn, labeled with sequence number, Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Address the remaining comments:
a) Regarding conditions of C9-12-04, in particular; the required unrestricted and perpetual vehicular and pedestrian cross-access; clarify or add the recordation information for this easement to plan view or as general note.
b) Revise/clarify label on planviews for recorded (Dkt.12011/pg.1274) "Existing Access Control Easement".
c) Assure that all easements are clearly identified on planviews, and in CC&R's, for the PAD's bridge crossing, public flowage, slope, private drainage maintenance, maintenance access, cross access, or any other easements. Easements not clearly identified by the Dedication need to be labeled as either private or public. Clarify which easement provides for the crossing in response letter or further clarify on plat as needed. Revised PUE as indicated on proposed revised sheet 3 (per email 19OCT15) is acceptable as long as there are no conflicts (overlap) with proposed floodplain limit and erosion hazard setback.
d) In Title Report Schedule B, item BO docket number appears transposed on plat; clarify. (Dkt.4126/pg.361)
e) Drainage Easement (Dkt.13380/pg.599), Electric Easement (68/428), and Access Easement (Dkt.10306/pg.367) were shown on plat but not indicated in Title Report Schedule B; these items may need to be provided to Title Agent for Title Report update. In Title Report Schedule B, utility related items AO, AQ, AX, BJ, BL. BN, BP, BQ, CE, CI were not found on plat planviews nor as blanket easement notes; please verify these easements do not exist on project site and revise Title Report, or show on plat.
f) It is also recommended that any delineations outside the boundary of the plat not be shown on these planviews, (ie Basis School label and delineation should be removed and "Bk37pg20" added in place of school label.)
2) Admin Man Secs.2-07.5.3 & 2-07.5.4.E: Provide registrants' seals with signatures on sheets.
3) Tucson Code Sec.26-8(b)(4), UDC Sec.8.3.1.A.2&3, 8.4.1.E.6: Address the remaining drainage related comments:
a) In the drainage report, the appendix states that there are areas that are susceptible to erosion and protective walls are proposed; therefore, development for lots 8 and 9 may require erosion protection improvements. Provide EHS calculations and engineering justification in hydrology report as discussed with Engineering Administrator, including exhibits showing both pre-developed and proposed post-developed floodplain limits and erosion hazard setbacks. In particular, also show and label Erosion Hazard Setback along the Tanque Verde on the plat planview sheet(s), within block plat boundary. All erosion hazards setback lines (differentiated from "non-erosive limit" for Tanque Verde EHS and EHS for local watercourse) shall be label Erosion Hazard Setback Line either on planview or in legend. Local watercourse EHS appears to be missing along northwestern portion of lot 9 near lot 6.
b) Existing and developed condition floodplain limits shall be clarified on planviews.
c) Concurrent (on top of other linetypes) existing floodplain delineations should be labeled for clarification.
d) Revise drainage report and provide 404 statement that clarifies if there are, or there are not, 404 watercourses on the site, and if there are, that there is no encroachment or that 404 permits will be obtained, or that there are no-disturbance areas shown on plat, etc.
e) Correct flood zone data in report (include discussion as to whether X-shaded zone is a jurisdictional 100-year zone or a 500-year zone).
f) Add as general note to Plat drainage maintenance notes per Tech Man Sec.4-04.14.3.2.
FINAL PLAT ASSURANCE / CC&R COMMENTS:
4) Admin Man Secs.2-07.5.3.E, 2-07.5.5.C.4.a, UDC Sec.8.6.2.A: Address the remaining assurance related comments:
a) Plat is missing required Assurance paragraph; please revise the Assurance section on sheet 1 and add the required paragraph: "This is to certify that all improvements, such as streets, sidewalks, sewers, water and utility installation, drainage and flood control facilities, and monuments, required by the City of Tucson have been completed or the future completion of such improvements has been assured by a land trust financial assurance agreement, the posting of performance bonds, an escrow account, letter of credit, or other security as the City of Tucson deems necessary and proper. In the event that any such assurance expires, lapses or is otherwise inadequate to assure the completion of assurable infrastructure, the city may suspend the issuance of building permits or certificates of occupancy."
b) If boundary survey monuments are not all set, and/or any other assurable improvement is not in place, assurances will be required. Final plat cannot be scheduled for Mayor & Council consideration until financial assurances are reviewed/approved. Address the following:
i) If assurable items are intended to be constructed after plat, then the assurance documents must be submitted with subdivision descriptions on any page, including exhibit descriptions, matching the title block description on the first sheet of the plat. Please be aware that the legal office may reject assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
ii) A third party trust is proposed for the subdivision assurances, address comments and resubmit:
(1) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list that includes erosion protection structure identified as an assurable item;
(2) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
(3) assure that all exhibits are attached, and the case number "S15-020" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
(4) copy of the original Trust Agreement;
(5) copy of a sample Warranty Deed;
(6) copy of the current Title Report.
c) The 8½" by 11" location map sheet submitted with the assurance submittals that go to Mayor & Council is acceptable except that it needs the subdivision case number added to the page.
5) Admin Man Sec.2-07.5.6: Address the following CC&R comments:
a) Submit revised copy of CC&R's that include maintenance of slopes, bank protection, erosion protection, and other drainage-related improvements. It is recommended that any reference to keynotes or other specifics on the plat be removed since there are incorrect references that are confusing in the CC&R's.
b) For billing/fee purposes, pagination of the CC&R's shall commence on cover page and be sequential through the document to the end of the document including index.
c) Once CC&R's are accepted for review, remove "draft" from document and provide a signed original copy that will be needed at mylar stage. It is recommended that before resubmittal, the CC&R's are provided for review/acceptance before signatures are affixed.
d) Add S15-020 to cover of CC&R's.
