Tucson Electric Power Co. (TEP) has reviewed the Final Plat for Rio Vista Verde and is unable to approve the plat at this time. There are existing TEP facilities located within Block 9 that are covered under a blanket easement in Book 4123 at Page 439. TEP requests that the location of transformer RBS-2 within Block 9 be surveyed and a 10’ by 10’ easement granted for this equipment by the plat. Once the plat is recorded with this easement shown, TEP will do a partial release of the existing easement, releasing the portion within the new plat. Attached is TEP facilities map identifying the equipment to be surveyed, and a copy of the granting easement.

2-07.1.0 APPLICABILITY

Final plats, block plats, minor subdivisions, and condominium plats shall be prepared according to the requirements provided below. Hereafter referred to as "plat" or "plats." A final plat serves as a survey document suitable for recordation of all or part of an approved tentative plat, if applicable. The final plat must conform to the approved tentative plat or site plan in lot configuration, design, and required conditions of development. The final plat, once approved, is recorded in the Pima County Recorder's Office. The final plat is kept on file and becomes part of the permanent record for the subject site. (Am. Admin. Directive, 5/14/2013)

2-07.2.0 APPLICATION SUBMITTAL REQUIREMENTS
Plat application packets are available from the PDSD Department. Completed applications and accompanying materials are submitted to the PDSD. Incomplete or inaccurate applications will not be accepted, nor will any application in which the pre-application conference or neighborhood meeting requirements have not been met. Should an incomplete submittal be accepted for review, the applicant should be aware that, because of a lack of information, the review will take longer since comments cannot be finalized until after the resubmittal when the required information is provided. The types of documents and the specific number of copies required of each of the documents are on the PDSD website or may be obtained from the CDRC office.

The following documents and information shall be submitted upon application:

2.1 Application Form
A completed application signed by the property owner or authorized designee;
2.2 Plat
A plat must be prepared to the format and content requirements described herein; and,
2.3 Fees
Fees in accordance with Section 4-01.0.0, Development Review Fee Schedule.

2-07.3.0 SUBMITTAL TIMING
Review of final plats is normally initiated after the tentative plat has been approved, unless concurrent tentative and final plat submittal has been approved by the PDSD prior to submittal. Final plats may also be submitted for review prior to the approval of a tentative if a minimum of one review of the tentative plat have occurred. In any case, submittal of the final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat.

2-07.5.0 CONTENT REQUIREMENTS

5.1 General

2-07.5.1.C If the project is located within the boundaries of a Planned Area Development (PAD) zone, include a reduced-scale map of the entire PAD on the first sheet, indicating the location of the portion being developed.

2-07.5.1.I A legend which shows and describes all symbols used on the drawing must be placed on either the first sheet of the plat or the first sheet which contains all or part of the subdivision drawing.

3. COMMENT: Add the line type used for the page separation to the legend.

2-07.5.2 General Notes
The plat must include the following general notes. Additional notes specific to each project are required when pertinent. Fill in the blanks with the project-specific information.

2-07.5.2.H Add the following note on all plats. The purpose of this note is solely for review for compliance with local and state laws governing subdivision and land splits. "There will be no further division of lots without the expressed approval of the City of Tucson."

4. COMMENT: Provide a general note stating "There will be no further division of lots without the expressed approval of the City of Tucson."

2-07.5.3 Standard Paragraphs
The plat must include the following statements, as applicable. All signatures must be in permanent, black, India ink and be accompanied by a notary signature and seal.

Provide the following information on the plat:
2-07.5.4.A. Indicate the name and width of each street, alley, easement (type), and drainage way within the subdivision boundary being created by this plat. Label each as public or private, along with the appropriate dedication notation;

5. COMMENT: There are several "EX" easements shown but the recordation information is not provided. Provide the recordation information for all existing easements.

6. COMMENT: There are several "EX" easements shown that state "BENDFIT OF "TSA"", clarify who or what "TSA" is.

2-07.5.6 Protective Covenants

7. COMMENT: Article 3.1 addresses access for the benefit of Blocks 1, 2, 3, 4, 5, 6, 7, 8 and 9 but does not address the existing access between the Basis School and Block 4. Will this access be closed off?

Dear Ms. Gehlen:

Southwest Gas Corporation (SWG) has no objection to the development of the above-mentioned project. Existing natural gas facilities are located in adjacent rights-of-way to the area of development and may be affected by construction of this project; specifically, an existing 4" gas main is located within the right-of-way of Craycroft Road and River road which may be impacted by pavement sawcutting along the eastern edge of Craycroft road and the southern edge of river Road and driveway grading into development. In addition, an existing 2" gas main is located at the southern and eastern end along with a ½" gas service to this development.

SWG has valves or test stations located within the project area that will need to be protected and may require adjustment to the final grade. The contractor must contact SWG for adjusting valves boxes at least two weeks prior to the start of construction by calling (520) 794-6208. SWG requests this information be added to the development plans.

Blue Stake and potholing are suggested for best accuracy when locating SWG facilities. Please be aware that SWG requires a minimum one-foot separation from distribution facilities and any proposed structures and two-foot separation from high pressure gas facilities. SWG requests the contractor use caution when working in the vicinity of gas facilities and protect and support gas facilities per Blue Stake requirements.

SWG also requests that no trees be planted within close proximity to gas facilities due to root intrusion; therefore, SWG requires all tree placements have a minimum eight-foot clearance from the tree center line to existing or proposed gas facilities. Shrubs and bushes may be planted within the eight-foot clearance zone.

All information is provided for reference use only. Please note that it is the responsibility of excavators or those developers planning excavation to verify actual field conditions in advance of construction so that requests for gas service or any potential issues can be addressed in a timely manner, including payment for conflict mitigation if applicable.

SUMMARY: This project site is susceptible to erosion and an erosion protection wall has been proposed near portions of the Tanque Verde embankment. In lieu of a Tentative Plat submittal, a comprehensive drainage report was to be provided that clearly addresses the floodplain and erosion hazards for the project (which), including technical engineering justification and erosion hazard calculations per Tucson Code. PDSD Engineering has reviewed block plat submittal for Rio Verde and does not recommend approval at this time until the following plat comments are addressed.

MASTER COVER SHEETS/ GENERAL NOTES:
1) Admin Man Sec.2-07.5.H: Add the subdivision case number (S15-020) in the lower right corner of each sheet of the final plat. Also provide PAD, any amendment, any rezoning, and subdivision case numbers in the lower right corner of each sheet.
2) Admin Man Secs.2-07.5.1, 2-07.5.2.E, 2-07.5.2.H: Add the following notes:
a) List applications and overlays.
b) Add floodplain use permit note for blocks impacted by erosion hazard setback and/or floodplain.
c) Add note: "There will be no further division of lots without the expressed approval of the City of Tucson."
d) "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public."
e) Dedication Language shall match verbiage in Admin Man Sec.2-07.5.3.B.2.a,b,c, and/or d.
3) Admin Man Sec.2-07.5.3.B.4: Make sure the property owners are correctly provided with beneficiary in Dedication sections on sheet 1.
FINAL PLAT SURVEY RELATED COMMENTS:
4) UDC Sec.8.4.1.E.3, Admin Man Sec.2-07.5.4.A: Assure that all easements are clearly drawn, labeled with sequence number, Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Show any sequence number of abandonment of existing 1-ft NVAE and add any new proposed 1-ft NVAE. Show any no-vehicular access easements where applicable. Show any easements for the PAD's bridge crossing, flowage, slope, drainage maintenance, or any other easements. Clarify Keynote A as to whether this easement is proposed for private drainage maintenance and private slope maintenance. Easements not clearly identified by the Dedication need to be labeled as either private or public. It is also recommended that any delineations outside the boundary of the plat not be shown on these planviews, (unless supplemental documentation is chosen to be provided similar to the Tentative Plat planviews).
5) Admin Man Secs.2-07.5.3 & 2-07.5.4.E: Provide registrants' seals with signatures on sheets.
6) Tucson Code Sec.26-8(b)(4), UDC Sec.8.3.1.A.2&3, 8.4.1.E.6: Show and label Erosion Hazard Setback along the Tanque Verde, within block plat boundary. Revise drainage report and provide 404 statement that doesn't use the statement that since this is a block plat there is no 404. Revise report to include proposed changes to erosion hazard setbacks and flood limits and change in location of embankment indicated on previously submitted development improvements. Correct flood zone data in report. Provide EHS calculations and engineering justification in hydrology report including exhibits showing both pre-developed and proposed post-developed floodplain limits and erosion hazard setbacks. Also clarify Flood Zone note on sheet 2 (missing comma or need re-wording?). Erosion hazard setback and "non-erosive limit" lines in legend are the same; provide differentiated delineations for these two lines, and show existing EHS from Tanque Verde on the planview sheet(s) per revised drainage report. See also previous floodplain use permit comments.
FINAL PLAT ASSURANCE COMMENTS:
7) Admin Man Sec.2-07.5.3.E: Plat is missing required Assurance paragraph; please revise the Assurance section on sheet 1 and add the required paragraph: "This is to certify that all improvements, such as streets, sidewalks, sewers, water and utility installation, drainage and flood control facilities, and monuments, required by the City of Tucson have been completed or the future completion of such improvements has been assured by a land trust financial assurance agreement, the posting of performance bonds, an escrow account, letter of credit, or other security as the City of Tucson deems necessary and proper. In the event that any such assurance expires, lapses or is otherwise inadequate to assure the completion of assurable infrastructure, the city may suspend the issuance of building permits or certificates of occupancy."
8) Admin Man Sec.2-07.5.5.C.4.a, UDC Sec.8.6.2.A: If survey monuments are not all set, or erosion protection structure is not constructed/as-built/accepted by the City, and/or any other assurable improvement is not in place, assurances will be required. The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are reviewed and approved. Address the following:
a) If assurable items are intended to be constructed after plat, then the assurance documents must be submitted with subdivision descriptions on any page, including exhibit descriptions, matching the title block description on the first sheet of the plat. Please be aware that the legal office may reject assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
b) A third party trust is proposed for the subdivision assurances, address comments and resubmit:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list that includes erosion protection structure identified as an assurable item;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S15-020" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the current Title Report.
c) The 8½" by 11" location map sheet submitted with the assurance submittals that go to Mayor & Council is acceptable except that it needs the subdivision case number added to the page.
