2-07.5.3.B.2.a - "(I/We) hereby dedicate and convey to the public forever all rights-of-way as shown hereon, including all streets, roads, parks, easements, and drainage-ways."

02. COMMENT: The previous plat dedicated a street named as Sarnoff Onclave Court. The abandonment of the street which includes a 1 foot no access easement must be approved through the City of Tucson prior to approval of the final plat. SUMMARY: Engineering has reviewed the resubmittal of the Final Plat submittal for Ebenezer Sarnoff Escalante Block 1 resubdivision. PDSD Engineering does not recommend approval until the remaining 4 comments are addressed.
MASTER COVER SHEETS/ GENERAL NOTES:
3) Admin Man Sec.2-07.5.3.B.4: Assure correct trust number is shown under Beneficiary of Trust section.
FINAL PLAT SURVEY RELATED COMMENTS:
4) UDC Sec.8.6.3, Admin Man Sec.2-07.5.5.C.4.b: Provide Northeast lot corner monument labeled to be set (if assurances are intended), or label as has been set (if no assurances are intended). See assurance comments.
8) Admin Man Sec.2-07.5.3: Provide signatures with seals.
FINAL PLAT ASSURANCE COMMENTS:
9) UDC Sec.8.6.2.A.3: Since the plat indicates not all survey monuments have been found, and it is unclear that the NE monument has been set (appears it may be intended to be set), then not all survey monuments are set, and if there are any other assurable improvement is not in place, revised set of assurances will be required. It is recommended that the RLS confirm or have set the remaining survey monument(s) and have the plat updated to reflect that the monument has been set (not to be set). Legend or notation next to monument would need to be revised by the RLS. Otherwise, the final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are reviewed and approved. Address the following:
a) Admin Man Sec.2-07.5.5.C.4.a: If the only remaining assurable item is the survey monuments and they are intended to be set before next submittal, then no assurances would be needed; clarify on plans / in certification statement by RLS that all monuments for this plat have been set.
b) If assurable items are intended to be constructed after plat, then the revised assurance documents must be submitted with subdivision descriptions on any page, including exhibit descriptions, matching the title block description on the first sheet of the plat. Please be aware that the legal office may reject assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
c) If a third party trust is proposed for the subdivision assurances, address comments and resubmit:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S15-005" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the current Title Report.
d) The 8½" by 11" location map sheet submitted with the revised assurance submittals that go to Mayor & Council is acceptable except that it needs the subdivision case number added to the page.

For resubmittal, submit revised final plat sheet, revised assurances as needed, comprehensive response letter addressing all comments, and title report. If you have any questions, do not hesitate to call me at 837-4934.
