COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Unified Development Code and Development Standards were addressed.

This plan has been reviewed for compliance with the Administrative Manual Standards listed in section 2-07 of the City of Tucson Administrative Manual. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC).

The review comments include the actual standard first with the applicable Administrative Manual section number and the following paragraph is the actual comment related to the specific item that must be addressed.

1. Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site Final Plat that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A Final Plat application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is .

SECTION 2-07: FINAL PLAT / MNOR SUBDIVISION
Section

2-07.3.0 SUBMITTAL TIMING
Review of final plats is normally initiated after the tentative plat has been approved, unless concurrent tentative and final plat submittal has been approved by the PDSD prior to submittal. Final plats may also be submitted for review prior to the approval of a tentative if a minimum of one review of the tentative plat have occurred. In any case, submittal of the final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat.
2-07.4.0 FORMAT REQUIREMENTS
Plats must:
4.1 Be on a 24-inch by 36-inch sheet(s) folded to the eight and one-half inch by 11-inch format shown in Exhibit I. The plat may comprise several sheets showing various elements of required data;
4.2 Be prepared on materials that can be transferred to double-matt Mylar reverse read;
4.3 Have a two-inch margin on the left side and one-half inch margins on the remaining sides to comply with standardization requirements of state law for recorded plats;
4.4 Be drawn to a scale of no more than one inch equals 40 feet; and,
4.5 All lettering and dimensions shall be three-thirty-seconds inch in height.
2-07.5.0 CONTENT REQUIREMENTS
2-07.5.1 General

2-07.5.1.H - The S(Year)-___ subdivision case number assigned to the approved tentative plat must be placed in the lower right corner of the plat next to the title block. If the property is subject to a rezoning case, the C9-__-__ rezoning case number is to be noted also.

01. COMMENT: This project has been assigned the PDSSD case number S15-005. List the case number in the lower right corner of the plat. Also list the annexation case number C9-71-44.

2-07.5.3.B.2.a - "(I/We) hereby dedicate and convey to the public forever all rights-of-way as shown hereon, including all streets, roads, parks, easements, and drainage-ways."

02. COMMENT: The previous plat dedicated a street named as Sarnoff Onclave Court. The abandonment of the street which includes a 1 foot no access easement must be approved through the City of Tucson prior to approval of the final plat. Contact Jim Rossi at 837-6718, with regards to the abandonment of the street.

2-07.5.3.D - Approval and Recording Data Blocks
The APPROVAL paragraph, where the City Clerk certifies that the plat has been approved by Mayor and Council, and the RECORDING DATA paragraph, which provides space for the recording information, must be placed on the first sheet of the plat adjacent to each other. The paragraphs are as follows.

Southwest Gas Corporation (SWG) has no objection to the development of the above-mentioned project. Existing natural gas facilities are located in adjacent rights-of-way to the area of development and may be affected by construction of this project; specifically, an existing 4" steel gas main is located within the right-of-way of Sarnoff drive and may be impacted by pavement sawcutting along the eastern edge of the ROW. In addition, an existing 4" steel gas main is located within the right-of-way of Escalante road.

SWG also requests that no trees be planted within close proximity to gas facilities due to root intrusion; therefore, SWG requires all tree placements have a minimum eight-foot clearance from the tree center line to existing or proposed gas facilities. Shrubs and bushes may be planted within the eight-foot clearance zone.

All information is provided for reference use only. Please note that it is the responsibility of excavators or those developers planning excavation to verify actual field conditions in advance of construction so that requests for gas service or any potential issues can be addressed in a timely manner, including payment for conflict mitigation if applicable. Blue Stake and potholing are suggested for best accuracy when locating SWG facilities.

SUMMARY: Engineering has reviewed the Final Plat submittal of for Ebenezer Sarnoff Escalante Block 1 resubdivision. PDSD Engineering does not recommend approval until the following comments are addressed.
MASTER COVER SHEETS/ GENERAL NOTES:
1) Admin Man Sec.2-07.5.1.H: Add the subdivision case number (S15-005) in the lower right corner of each sheet of the final plat. Also provide any amendment, any rezoning, annexation case number C9-71-44, and old subdivision case numbers in the lower right corner of each sheet.
2) UDC Sec.8.6.6, Admin Man Sec.2-07.5.3.B.2: Clarify 2nd paragraph under Dedication. If right-of-way is to remain, then dedication paragraph 2 would apply; if right-of-way is to be vacated, then 2nd paragraph should be revised to match Admin Man Sec.2-07.5.3.B.2.b would more closely match intent.
3) Admin Man Sec.2-07.5.3.B.4: Make sure the property owners are correctly provided with beneficiary in Dedication sections on sheet 1. For parcel 136-14-2120, FIDELITY NATIONAL TITLE TR 60343 is listed in assessor documents for ENCLAVE AT SARNOFF LLC.
FINAL PLAT SURVEY RELATED COMMENTS:
4) UDC Sec.8.6.3, Admin Man Sec.2-07.5.5.C.4.b: Provide Northeast lot corner monument labeled to be set (if assurances are intended), or label as has been set (if no assurances are intended). See assurance comments.
5) Admin Man Sec.2-07.5.4.E: There is approximately 16-ft vertical change at west slope portion of site. Consider providing slope easement along west property boundary, and label whether private or public. Keep in mind differential grading requirements are triggered when fill exceeds 2-ft within 100-feet of residential properties.
6) Admin Man Sec.2-07.5.5.B: Clarify / label cul-de-sac. Although it appears that the cul-de-sac was created by initial plat, verify with TDOT first, since vacation of right-of-way typically is required prior to plat going to M&C. Otherwise, label Sarnoff Enclave Court to be abandoned by this plat.
7) UDC Sec.8.4.1.E.3, Admin Man Sec.2-07.5.4.A: Assure that all easements are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Specifically address the following easement comments:
a) Show no-vehicular access easements where applicable. Consider a 1-ft NVAE at south lot boundaries or other locations excluding access area adjacent to existing street. (Admin Man Sec.2-07.5.4.H)
b) Label recorded sequence numbers for abandonment of 1' no access easement and 5' public utility easement.
8) Admin Man Sec.2-07.5.3: Provide expiration date for surveyor's seal. Certification statement for civil engineer shall include certification of slope easement if any.
FINAL PLAT ASSURANCE COMMENTS:
9) UDC Sec.8.6.2.A.3: If survey monuments are not all set, and any other assurable improvement is not in place, revised set of assurances will be required. The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are reviewed and approved. Address the following:
a) Admin Man Sec.2-07.5.5.C.4.a: If the only remaining assurable item is the survey monuments and they are intended to be set before next submittal, then no assurances would be needed; clarify on plans / in certification statement by RLS that all monuments for this plat have been set.
b) If assurable items are intended to be constructed after plat, then the revised assurance documents must be submitted with subdivision descriptions on any page, including exhibit descriptions, matching the title block description on the first sheet of the plat. Please be aware that the legal office may reject assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
c) If a third party trust is proposed for the subdivision assurances, address comments and resubmit:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S15-005" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the current Title Report.
d) The 8½" by 11" location map sheet submitted with the revised assurance submittals that go to Mayor & Council is acceptable except that it needs the subdivision case number added to the page.
10) Admin Man Sec.2-07.5.3.E: Plat is missing required Assurance paragraph; please add the required paragraph: "This is to certify that all improvements, such as streets, sidewalks, sewers, water and utility installation, drainage and flood control facilities, and monuments, required by the City of Tucson have been completed or the future completion of such improvements has been assured by a land trust financial assurance agreement, the posting of performance bonds, an escrow account, letter of credit, or other security as the City of Tucson deems necessary and proper. In the event that any such assurance expires, lapses or is otherwise inadequate to assure the completion of assurable infrastructure, the city may suspend the issuance of building permits or certificates of occupancy."
