This plan has been reviewed for compliance with the Unified Development Code (UDC) Administrative Manual (AM) Section 2-06. Also compliance with applicable development criteria for the proposed use as listed in the City of Tucson Uniform Development Code (UDC) and the UDC Technical Standards Manual (TSM).

1. UDC Section 8.5.2.A, Final Plat Approval Period. A final plat shall be approved and recorded within three years of the tentative plat approval date. A final plat is subject only to the ordinances in effect at the time of the tentative plat application except where an ordinance specifically states that it applies to pending applications.

SECTION 2-07.0.0: FINAL PLAT, BLOCK PLAT, MINOR SUBDIVISION, AND CONDOMINIUM PLAT APPLICATIONS

2-07.5.3.D Approval and Recording Data Blocks. The APPROVAL paragraph, where the City Clerk certifies that the plat has been approved by Mayor and Council, and the RECORDING DATA paragraph, which provides space for the recording information, must be placed on the first sheet of the plat adjacent to each other. The paragraphs are as follows.

1. COMMENT: Revise the year listed in the "APPROVALS" block from 2014 to 2015 or leave it blank.

2-07.5.6 Protective covenants or Covenants, Conditions, and Restrictions (CC&Rs) establishing responsibility for construction, maintenance, and ownership of any proposed common area, open space, private street, or similar joint use, when needed.

SUMMARY: Engineering Division of Planning and Development Services Department has received the proposed Final Plat. Engineering Division has reviewed the submitted Final Plat and does not recommend approval at this time. Refer to this link for further clarification:

The following items need to be addressed:

FINAL PLAT COMMENTS:

1) AM Sec.2-07.5.3.B.4: Revise the Final Plat and all applicable sections to provide the correct date of "2015" where indicated by "2014."

2) AM Sec.2-07.5.4.F: Revise the Final Plat to label and dimension the limits of the 100-year floodprone area in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines. The second revision only provided this information for the EHSB.

3) AM Sec.2-07.5.6: Revise the CC&Rs to provide the following information within the CC&Rs:

a) Revise the CC&Rs Title on Sheet 1 to accurately describe the property (Name, number of Units 1-16, common elements (with descriptions), and limited common elements (with descriptions)) per the Title Block.

b) Provide an Exhibit (Exhibit A) within the CC&Rs for the property descriptions. All exhibits must match the Title Block to be a complete package.

4) AM Sec.2-07.5.6: A signed and original notarized copy of the CC&Rs will be required prior to Final Plat Mylar approval. Verify that the dates within the CC&Rs are revised to correctly reference "2015."

5) AM Sec.2-07.6.1.B: The final plat cannot be scheduled for Mayor and Council consideration until either Financial Assurances are submitted or a copy of a performance bond for the project is submitted. The final plat cannot be scheduled for Mayor and Council consideration until Financial Assurances are submitted and approved. It is recommended that the Assurances be provided now for review to help facilitate the Mylar submittal.

6) AM Sec.2-07.6.1.E: Submit two copies of an updated title report (current within 30 days) at Mylar submittal. A statement from the title company certifying the title report previously submitted is still valid is acceptable in place of an additional title report.

GENERAL COMMENTS:

Provide a Final Plat, Assurances and CC&Rs at re-submittal addressing the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.
