If these common areas are for the exclusive use of each individual unit they should be labeled as limited common elements which would match the CC&R description. The Plat, Title Block and CC&Rs must match in description for all Common Elements and Limited Common Elements. 13) AM Sec.2-07.5.4.C: Revise the Final Plat to label the area shown in front of each garage, approximately a 7'x35', with a CE designation. The Plat, Title Block and CC&Rs must match in description for all Common Elements and Limited Common Elements. 14) AM Sec.2-07.5.4.C: Revise the Final Plat and Title Block for CE "B" (Limited Pedestrian). Clarify how this area can be a limited element when sidewalks within this element provide access for all units to the pedestrian circulation located within the public right-of-way. Per the CC&Rs CE "B" is described as a Reserved Common Element. The Plat, Title Block and CC&Rs must match in description for all Common Elements and Limited Common Elements. 15) AM Sec.2-07.5.4.F: Revise the Final Plat to label and dimension the limits of the 100-year floodprone area in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines. 16) AM Sec.2-07.5.5.A: Revise the Final Plat so at least one corner of the subdivision is tied by course and distance to a section corner, quarter section corner or an established survey monument. 17) AM Sec.2-07.5.5.C.1: Revise the Final Plat to provide a reference to the Basis of bearings. The purpose of the basis of bearings on a survey is to enable another surveyor to retrace the original survey. As such, the statement must be referenced to found, readily locatable monuments. The basis of bearings should be established from two (2) found, physically monumented points described and shown on the final plat. If the monuments at each end of the reference line are fully described on the plat, they need not be described in the "Basis of Bearings" statement; i.e. the Survey References Section, clarify. 18) AM Sec.2-07.5.5.C.4.a: Revise the Final Plat to provide a pin at all lot junctions as either found or set. A one-half inch iron rod tagged by a registered land surveyor must be set at all corners upon completion of construction. 19) AM Sec.2-07.5.5.C.5: Revise the Final Plat to clearly indicate whether the distance and bearings between monuments were measured or calculated for all property line boundary information. This can be labeled in plan view are as a note within the General Note Section or Legend. 20) AM Sec.2-07.5.6: Revise the CC&Rs to accurately reflect all of the proper common elements and limited common element labels and responsibility for maintenance and liability for any proposed commonly-owned areas. Revise the following information within the CC&Rs: a) Revise all sections to accurately describe the property (Name, number of lots, common elements (with descriptions), and limited common elements (with descriptions)) per the Title Block. Either the CC&Rs or the Title Block must be revised and must match with exact wording for the name and all common elements. b) Revise/Clarify Sections 3.4.1, 3.6.1 and 3.6.3 within the CC&Rs compared to the Title Block. If the common elements and limited common elements are to be as described in the CC&Rs then the Title Block needs to be revised to reflect, refer to the above comments that reflect the changes required for the Title Block on the Final Plat. c) Provide an Exhibit (Exhibit A) within the CC&Rs for the property descriptions. All exhibits must match the Title Block to be a complete package. 21) AM Sec.2-07.5.6: A signed and original notarized copy of the CC&Rs will be required prior to Final Plat Mylar approval. 22) AM Sec.2-07.6.1.B: The final plat cannot be scheduled for Mayor and Council consideration until either Financial Assurances are submitted or a copy of a performance bond for the project is submitted. The final plat cannot be scheduled for Mayor and Council consideration until Financial Assurances are submitted and approved. 23) AM Sec.2-07.6.1.E: Submit two copies of an updated title report (current within 30 days) at Mylar submittal. A statement from the title company certifying the title report previously submitted is still valid is acceptable in place of an additional title report. The Title Report submitted has an effective date of December 2, 2013. GENERAL COMMENTS: Provide a revised Final Plat, Assurances and CC&Rs at re-submittal addressing the comments provided above.
