COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Unified Development Code (Section 8.4.1) and the Administrative Manual (Section 2-07) were addressed.


The consultants attend a pre-submittal meeting and the final plat for a minor subdivision was approved for submittal on October 10th of 2013 (UDC 8.4.1.C).

2-07.3.0 SUBMITTAL TIMING
"Review of final plats in normally initiated after the tentative plat has been approved, unless concurrent tentative and final plat submittal has been approved by the PDSD prior to submittal. Final plats may also be submitted for review prior to the approval of a tentative if a minimum of one review of the tentative plat have occurred. In any case, submittal of the final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat."

"A final plat shall be approved and recorded within three years of the tentative plat approval date. A final plat is subject only to the ordinances in effect at the time of the tentative plat application except where an ordinance specifically states that it applies to pending applications" (UDC Section 8.5.2.A Final Plat Approval Period).

COMMENT:
This subdivision plat was submitted October 30th 2013. The final dated for approval is October 31st 2016.


"Place the words 'SEQ#_______' in both the upper and lower right corners outside the margin line. The blanks will be completed by the Pima County Recorder's Office at the time of recordation" (AM 2-07.5.1.D).

COMMENT:
Add "#___________" to the SEQ references you have provided outside the margin line.

ADDITIONAL INFORMATION:
Place the sequence number reference outside the margin in the upper right corner so that it reads from the right side of the sheets and provide the underline for both locations. (See green-lines.)

"Dedication Language. Use one (1) of the following four (4) statements as may be appropriate for the plat. Section 2-07.5.3.B.2.c may be used in subdivision with private elements. Section 2-07.5.3.B.2.d may be used where electrical facilities are not specifically located on common areas" (AM 2-07.5.3.B.2).

COMMENT:
The dedication statement should have reference to the "Declaration of Restrictions and Cross-Easement Agreement" with recording information on the plan. The cross-access and cross parking agreement needs to be revised to reflect the new configuration and ownership of the parcels of the shopping center (AM 2-07.5.3.B.2.c). The Taco Bell declarations do not appear to address all of the concerns reflected in the Declaration of Restrictions and Cross-Easement Agreement.

ADDITIONAL INFORMATION:
The CC&Rs must reflect the new subdivision configuration with cross access and cross parking. Access easements must be provided, either on the plat or within the CC&Rs.. There is no access, nor is there cross parking, for the new lot.

RESUBMITTAL OF THE FOLLOWING IS REQUIRED: Revised Final Plat for the Minor Subdivision plat and any requested documents.

Provide the revised access and parking agreement, and if there are any changes to the plat, copies of the plat. Also provide the CDs.
