The Approval Paragraph already includes the recording language that is needed making the Recording Data paragraph obsolete. 4) AM Sec.2-07.5.4.I: Revise the Final Plat to show the on-site retention area in a surveyable manner as per Book 62 Page 58 of the original subdivision. 5) AM Sec.2-07.5.6: Provide a copy of Covenants, Conditions and Restrictions (CC&Rs) or Protective Covenants that establish responsibility for construction, maintenance and ownership of all proposed common areas, open space, vehicle use area, detention/retention basin, etc. A cross access and cross parking agreements must be addressed along with responsibility for maintaining and operating the existing drainage infrastructure. GENERAL COMMENTS: Provide a revised Final Plat and CC&Rs at re-submittal addressing the comments provided above. This review letter may contain comments pertaining to the concerns of either Department. PCRWRD hereby rejects the above referenced submittal of the Final Plat received by us on October 24, 2013, for the following reason. 1. Sheet 1 of 3, Dedication block: Within this dedication there are no provisions that address the access, operation, maintenance or installation of shared elements (i.e. private sewer, water, electricity, gas, etc.) that traverse this development. Contact COT Development Review staff for guidance on revised dedication language. 2. Sheet 3 of 3: Private sewers elements presently exist that traverse across future lots 5 and 6, and are not located within defined easements, which if easements were to be established, would allow property owner(s) legal access to operate, maintain, repair or replace, infrastructure required for sanitary wastewater conveyance from lots 3 and 4. Revise the drawings so that legal private sewer easements are identified, dimensioned and dedicated; either by separate recording or along with this final plat, across lots 5 and 6. The next submittal will be the second submittal for this Final Plat. The RWRD review fee for the second submittal will be $100.00 (Per PC Code, Title 13.20.030.A.2).
