| 10/28/2013 | JOE LINVILLE | LANDSCAPE | REVIEW | Reqs Change | 1) TSM 4-02.2.4 Identification of Regulated Areas and Protected Riparian Areas All tentative plats, site plans, plot plans or other plans providing for approval of development within property that includes any regulated area as defined in Section 4-02.2.2.A, ERZ Watercourses, shall identify and delineate the regulated areas and the protected riparian area on the property and shall comply with this standard. The boundary of the regulated area and the protected riparian area should be clearly depicted on applicable submittal documents. The Naylor Wash is subject to the WASH Regulations (per TCC 29 Art. VIII, sec 29-14) and the "regulated area" includes channel and banks of a watercourse and the area within 50 feet of the top of the bank, or where there is no defined bank, 50 feet from the ten-year flood boundary. 2) AM 4-02.2.6.A Ownership of PRA Ownership of the protected riparian area shall be provided in one or more of the methods set forth below to insure continued preservation of the area. Forms of ownership of protected riparian areas include: "A. protected riparian areas for proposed subdivisions may be either publicly owned, owned by a common association, or owned by a non-profit association which provides for conservation management. " The response letter indicates that there is no common association or other public or private association designated to provide conservation management. It appears that a Technical Standards Modification Request (TSMR) per TSM 1-01.6.1.A will be required due to non-conformance with the standard. 3) AM 4-02.2.6.A D. Where the protected riparian area is on property that remains under the ownership of a single person or entity following the development, the protected riparian area shall be protected through a conservation or public easement or other legal restriction upon further development. In order to establish the extent of the protected riparian area on this site, an Environmental Resource Report per TSM 4-02.2.4.B.1 is required. The ERR received appears to address only portions of Block 1 and should address the remainder of Block 1 (west of the access driveway) and the remaining affected proposed Blocks. Please note that per TCC CH. 29 Art. VIII that the "resource area" consists of the channel and banks of a wash, and those portions of the study area containing vegetative resources and wildlife habitat areas. 4) The ERR erroneously states that A Plant Inventory is not required. A plant Inventory is required per TSM 4-02.2.5.B.1.r (unless modified per TSM 4-02.2.5.B.1) "all development proposals shall be accompanied by an inventory of the existing vegetation and wildlife habitats within the study area." |
