SUMMARY: Engineering Division of Development Services Department reviewed the Block Plat submittal, and does not recommend approval until the following comments are addressed.

BLOCK PLAT ASSURANCE COMMENTS:
1) Admin Man Sec.2-07.5.4.C: CC&R's reference "Common Areas & Easements" yet only a drainage area is shown on the plat. Revise CC&R's to reflect revised plat after comments are addressed.
2) UDC Sec.8.6.2.A.3: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. It appears the assurance comments were not completely addressed. Address and submit the following:
a. Address third party trust assurance comments:
i. original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list;
ii. original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii. copy of the original Trust Agreement;
iv. copy of a sample Warranty Deed;
v. copy of the current Title Report.
vi. Assure that all exhibits are attached, and the case number "S13-022" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
vii. Correct reference for Recitals paragraph B on page 1, and Agreement paragraph 3 on page 2, of Agreement to Construct.
viii. On the Agreement to Construct correct type-over on bottom right of each page, and correct blank page 7.
ix. The assurance descriptions shall match the title block description on the first sheet of the Final Plat. Check each page of exhibits and first page. Please be aware that the legal office may reject assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block. Incorrect gaps, punctuation, and spelling have been rejected in past; correct assurance documents to match plat.
x. On the Agreement to Construct, add standard assurable item per City Attorney: "If any credits against the impact fees have been requested, all improvements that are the subject of the requested credit shall be completed and accepted by the City prior to the final release of assurances. Assurances may be partially released prior to the completion of all improvements provided the releases are proportional to the level of completion of improvements."
xi. Remove assurable item 1 as this does not match City of Tucson requirements.
