Section 3.3.3.G.5.c UDC, An applicant has one year from the date of application to obtain approval of a site plan that complies with zoning and other development requirements in effect at the time of application, unless an ordinance adopted by Mayor and Council during this period states otherwise. A site plan application that has been in review for a period of one year and has not yet been approved is considered denied. To continue the review of a site plan for the property, a new site plan must be submitted that complies with regulations in effect at the time of re-submittal. The new submittal initiates a new one-year review period. One year Expiration date is August 20, 2013 .

1. The Zoning Review Section approves the final plat for this subdivision. However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised final plat to verify that those changes do not affect any zoning requirements.

SUMMARY: Engineering Division of Planning and Development Services Department has received and reviewed the proposed Final Plat, Condominium Declaration and Title Report. Engineering Division has reviewed the submitted Final Plat and recommends conditional approval at this time.

The following items need to be addressed prior to Final Mylar submittal and Mayor and Council scheduling:

FINAL PLAT COMMENTS:

1) Restated: AM Sec.2-07.5.6: Revise the Covenants, Conditions and Restrictions (CC&Rs) to accurately describe the property per the Title Block on the Final Plat, specifically included and describe the Common Elements and Limited Common Elements in the first paragraph of the CC&Rs to match the Title Block with exact wording for all common/limited common elements. Also Section 1.2.Z (page 4) needs to be revised to read "Sequence #" not "Book __ of Maps, page__"; All blanks must be filled in, specifically Section 7.4.2.1 (page 22); Revise Exhibit A (page 38) so that the description reads word for word per the Title Block.

2) Restated: AM Sec.2-07.5.6: It is acknowledged that a signed and original notarized copy of the CC&Rs was provided however due to the required changes the CC&Rs will need to be re-notarized at Final Plat Mylar approval.

GENERAL COMMENTS:

If the Consent to Dedicate is also a fixture filing, there is an additional $3 fee. If you are unsure of the fees, please call the County Recorders Office.
