1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before March 07, 2014.

2. D.S. 2-03.6.6 The covenants, conditions and restrictions (CC&Rs) will need to be recorded prior to approval of the final plat.

3. The final plat cannot be approved until the tentative plat, DP12-0141, has been approved.

This review letter may contain comments pertaining to the concerns of either Department.
PCRWRD hereby approves the above referenced submittal of the Final Plat received by us on March 7, 2013.
Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) will need to be obtained from PDEQ.

SUMMARY: Engineering Division of Planning and Development Services Department has received and reviewed the proposed Final Plat, Assurances Package, Title Report and copy of the CC&Rs. Engineering Division has reviewed the submitted Final Plat and supplemental information and does not recommend approval of the Final Plat at this time. The following items need to be addressed:

FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.K: Revise the Final Plat to indicate the subdivision cases number assigned (S13-007) in the lower right corner of the plans on all sheets.

2) DS Sec.2-03.6.4.C: Revise the Title Block to correctly label the description for Common Area "A." The description should also reference the Retention Area as per plan view, i.e. Common Area "A" (Landscape, Retention Area and Bufferyard).

3) DS Sec.2-03.6.4.C: Revise plan view on Sheet 2 to provide a dimension for Common Area "A" along the eastside of the property.

4) DS Sec.2-03.6.6: Provide an original, signed copy of the CC&Rs with all the blanks filled in, the Sequence # recordation, and correct description for Common Area "A" and verify that the sections are numbered in correct order (example is Page 3 goes from 1.25 to 1.27).


ASSURANCE PACKAGE COMMENTS:

5) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Revise the assurance package and address the following comments:

I. Amendment to Trust:
a) Provide an original, signed, and notarized Amendment to Trust. Verify all blanks have been filled in appropriately.
b) Provide the subdivision case number in the appropriate space.
c) Provide the correct description for Common Area "A" (to include Retention Area) within the 1st paragraph and also within Exhibit "A".
d) Correct the spacing in the 1st paragraph between the words "and" and "Mahalo."
II. Agreement to Construct:
a) Provide the subdivision case number in the appropriate space on Page 1 and Exhibit "B."
b) Provide the correct description for Common Area "A" (to include Retention Area) in all applicable Sections and Exhibits.
c) Revise Page 5 under the reference to the City to correctly state City of Tucson, Planning & Development Services Department, Engineering Division. The words "Planning &" must be included.
d) Revise the paging count to reference Page 6 of 7 on Page 6 (it appears on the top right corner of Page 7, formatting correction).
e) Revise Item #1 of Assurable Items located in Exhibit "B to state "Paving of public streets…." The word "public" must be within the line item.
f) Provide Exhibit "C" to Exhibit "A" as referenced on the last page of the package.
g) Provide an original, signed, and notarized Agreement to Construct. Verify all blanks have been filled in appropriately.
III. For this and future projects, please provide an 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.

GENERAL COMMENTS:
