The subject project has been reviewed. The project can not be approved at this time. Address the following comments before review can continue. Prepare a detailed response that explains the revisions that where made and references the exact location in the Final plat and in the Title Report where the revisions were made:

Final Plat:

1. Provide 2" margin on the left side and 1.5" margin on the remaining sides as required by D.S. 2-03.6.1.B.
2. Provide the complete S11-050 case number on every sheet (D.S. 2-03.6.1.K.).
3. Since the approved Tentative Plat/Development Plan does not have the proposed lot lines, submit a supplemental plan that shows the lot lines and all proposed improvements, including buildings, drainage facilities, parking areas, P.A.A.L's and easement, in order to clarify that the proposed lot lines and improvements will not be in conflict.
4. The gross area of the subdivision does not match the area shown on the approved Development Plan. Clarify the discrepancy (D.S. 2-03.6.2.A.).
5. Provide a general note which states: "A floodplain use permit is required for all improvements that are proposed within the areas that are affected by the regulatory floodplain (D.S. 2-03.6.2.E.).
6. Add the following general note: "Any relocation, modification, etc. of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public" (D.S. 2-03.6.2.I.).
7. Since the project does not appear to have private streets, remove any reference to private streets in the "Dedication" (D.S. 2-03.6.3.B.2.c).
8. It appears that the description of Common Area "C" is incorrect. Correct the description on both sheets.
9. It is not clear if assurances are required, for this subdivision, to assure the construction of the proposed infrastructure within the common areas. If assurances are submitted in the form of a "Third Party Land Trust", The "Beneficiary" Block must be added (D.S. 2-03.6.3.C.) and (D.S. 2-03.6.3.E.).
10. In the "Assurances" Block, replace "City of Tucson Engineer" by "City of Tucson Development Services Department Engineering Administrator" (D.S. 2-03.6.3.E.).
11. Is the company requesting the recordation of the plat called "The Architecture Company" or this is a generic name that needs to be replaced with the real name? (D.S. 2-03.6.3.D.).
12. Ensure that all applicable easements described in the Title Report are shown on the plat (D.S. 2-03.6.4.A.).
13. Show the required setbacks from the proposed detention/retention basins (D.S. 2-03.6.4.E.).
14. Show the detention/retention areas (within the common areas) in a surveyable and readily retraceable manner (D.S.2-03.6.4.I). Showing the survey information of the common areas within which there are detention/retention basins does not suffice.
15. In order to expedite the plat review and approval, provide the boundary survey and closure calculations report in accordance with D.S. 2-03.6.5.C.3.
16. Submit a copy of the project CC & R's. The CC & R's shall specifically address the maintenance of the drainage facilities. The CC & R's should include a paragraph, which addresses the maintenance of the drainage structures in details (i.e. what facilities to be inspected and maintained, how, when, by whom, the detention/retention basin maintenance list, keeping records, and repair decisions, etc). This Office also recommends including a Drainage Facilities maintenance checklist in the CC & R's to facilitate the Lot Owners Association maintenance responsibilities (D.S.2-03.6.6.).

5. DS 2-03.6.6 Provide a copy of the recorded CC&Rs indicating maintenance for common areas, cross access, cross parking agreements, etc.

6. DS 2-03.6.3.D In the blank for the approval portion of the final plat, place the city clerks name, Roger W. Randolph.

The drawings of the Final Plat for the proposed project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Regional Wastewater Reclamation Department (PCRWRD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The PDEQ and the PCRWRD hereby reject the above referenced submittal of the Final Plat as received by us on October 11, 2011, for the following reasons:

1. All sheets, Title Block: Boldly show the entire project case number, adjacent to the Title block.

2. Sheets 1 and 2: Revise the Area map and the Final Plat so that they show the existing Public Sewer Easement. Where appropriate show easement dimensions and recording information.

3. Revise the Dedication block, second paragraph, first sentence, so that: …COMMON AREAS… ARE GRANTED (or dedicated) AS EASEMENTS TO CITY OF TUCSON, PIMA COUNTY AND UTILITY COMPANIES…


4. Project has not been sealed by RLS or PE.

The next submittal will be the second submittal for this Final Plat. The RWRD review fee for the second submittal will be $100.00 (Per PC Code, Title 13.20.030.A.2). Please let me know if you have any questions.
