1. UDC Section 8.5.2.A, Final Plat Approval Period. A final plat shall be approved and recorded within three years of the tentative plat approval date. A final plat is subject only to the ordinances in effect at the time of the tentative plat application except where an ordinance specifically states that it applies to pending applications.

SECTION 2-07.0.0: FINAL PLAT, BLOCK PLAT, MINOR SUBDIVISION, AND CONDOMINIUM PLAT APPLICATIONS

2-07.5.1.E.1 Provide a title block in the lower right corner of each sheet with the following information: Subdivision name; number of blocks, lots, and/or units; and common area;

1. COMMENT: The final plat title block should reflect the information shown on the tentative plat title block. Revise "TRACTS" to read "BLOCKS".

2-07.5.1.H The S(Year)-___ subdivision case number assigned to the approved tentative plat must be placed in the lower right corner of the plat next to the title block. If the property is subject to a rezoning case, the C9-__-__ rezoning case number is to be noted also.

2. COMMENT: Remove the extra "-" from the case number "S-11-043" should be "S11-043".

2-07.5.2.D If the property is subject to conditions of rezoning, add the following note: "This plat is subject to the conditions of rezoning case number C9-__-__, unless superseded by a subsequent rezoning ordinance."

3. COMMENT: Provide a general note stating "THIS PLAT IS SUBJECT TO THE CONDITIONS OF REZONING CASE NUMBER C9-06-32, UNLESS SUPERSEDED BY A SUBSEQUENT REZONING ORDINANCE".

2-07.5.3.D Approval and Recording Data Blocks. The APPROVAL paragraph, where the City Clerk certifies that the plat has been approved by Mayor and Council, and the RECORDING DATA paragraph, which provides space for the recording information, must be placed on the first sheet of the plat adjacent to each other. The paragraphs are as follows.

4. COMMENT: The approval block does not match AM Section 2-07.5.3.D. Review Section 2-07.5.3.D and revise the approval block.

5. COMMENT: As this plat will not be approved prior to the end of 2013, either change the year to "2014" or remove the year so that it can be hand written at a later date.

2-07.5.4.B Identify each block or lot within the subdivision boundary by number, and include the square footage of each.

6. COMMENT: The tentative plat shows "TRACKS" "A" and "B" as "BLOCKS". Revise sheets 1, 3, 4 & 5 to show "BLOCKS" not "TRACKS".

2-07.5.6 Protective covenants or Covenants, Conditions, and Restrictions (CC&Rs) establishing responsibility for construction, maintenance, and ownership of any proposed common area, open space, private street, or similar joint use, when needed.

7. COMMENT: The title on the CCR&Es should match the title block of the plat.

8. COMMENT: The "TABLE OF CONTENTS" (TOC) does not match the document;

SUMMARY: Engineering has reviewed the submitted development package for the Final Plat, including Final Plat sheets, copy of supplemental CC&R's, copy of schedules A & B of Title Report, copy of the Agreement to Construct, and other documents, and does not recommend approval of the Final Plat until the following comments are addressed.

MASTER COVER SHEETS/ GENERAL NOTES:
1) The following comments pertain to general notes or drafting-related:
a) Admin Man Sec. 2-07.5.H: Correct format of subdivision case number (S11-0043) in the lower right corner of each sheet of the final plat.
b) Admin Man Sec.2-07.5.3.E: Correct missing verbiage for the ASSURANCE block per this section of requirements: "In the event that any such assurance expires, lapses or is otherwise inadequate to assure the completion of assurable infrastructure, the city may suspend the issuance of building permits or certificates of occupancy."
c) Correct signature lines for City of Tucson Planning and Development Services Department.
d) Add a note regarding Greenway Corridor improvements (Block 11) to be constructed as a part of the subdivision improvements. Separate permit may be required for grading.
2) Tech Man Sec.4-04.14.3.2. Add general note to Final Plat stating (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for basin/drainage structures; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the basin/drainage facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the basin/drainage facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the basin/drainage facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities.

FINAL PLAT SURVEY RELATED COMMENTS:
3) UDC Sec.8.4.1.E.3, Admin Man Sec.2-07.5.5: Address the following survey comments:
a) Lot corner monumentation is not clear on planview - clarify.
b) The north no-vehicular access easement appears to blend into the north boundary line; clarify end of NVAE delineation on planview.
c) Add NVAE and FD to legend.
d) Add Basin setback for lot 26 on sheet 2.
4) Admin Man Sec.2-07.5.4.A: Assure that all easements including those listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Please be aware that per Technical Standard 11-01.4, if easements are relocated, not in use, or proposed for abandonment, then the documentation of the vacation/abandonment/relocation shall be submitted prior to approval of Final Plat. Address the following easement related comments:
a) The request for abandonment of the utility easements as indicated should have been made to the entity holding an easement interest shortly after the City Development Review Committee (CDRC) approval of the tentative plat. Schedule B Item 18 (2011-2440170) was not found during the Tentative Plat review, and the following easements on the Tentative Plat submittal were not found on the Title Report and will need to be addressed at this stage of the platting:

It may be necessary to meet to go over the easements in a meeting and go over the existing plat, proposed plat, and title report documentation.
c) Admin Man Sec.2-07.5.5: State whether horizontal boundary data for this phase of the subdivision closes - provide closure document.
d) Provide a copy of any updated Title Report, Schedule B in resubmittal.

FINAL PLAT ASSURANCE COMMENTS:
5) UDC Sec.8.6.2.A.3: If survey monuments are not all set, street improvements, and any other assurable improvement is not in place, and accepted under permit(s), assurances will be required. The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are reviewed and approved. Call/email for latest versions of Third Party Trust assurance forms. Address the following:
a) The assurance descriptions on any page, including exhibit descriptions, shall match the title block description on the first sheet of the Final Plat. Please be aware that the legal office may reject assurance paperwork if the verbiage / punctuation does not match exactly the verbiage / punctuation on the Final Plat's Title Block. Call to discuss Title Block description and subdivision descriptions shown on assurance agreement.
b) In Agreement to Construct, add to assurable items that the Greenway Corridor improvements adjacent to north boundary shall be constructed.
c) A third party trust is proposed for the subdivision assurances, address comments and resubmit:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S13-031" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the current Title Report.
d) For processing, provide a 8½" by 11" location map sheet submitted with the assurance submittals that go to Mayor & Council with the subdivision case number added to the page.
6) Admin Man Sec.2-07.5.4.C: Revise CC&R's to reflect revised plat after comments are addressed. Address the following comments:
a) Subdivision description of the CC&R's should match the title block description on the first sheet of the Final Plat. Please be aware that the legal office may reject this paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
b) Explain whether there are additional CC&R's that apply to this site (whether there is a master CC&R for the Bridges that applies). Check to make sure that there are no conflicts with maintenance responsibility requirements per Tech Man Sec.4-04.14.3.2 (see for instance section 15.3.3 of the CC&R's). Provide a copy of any other CC&R's with which this subdivision must conform.
c) Add Subdivision Case number to the CC&R's.
d) Assure that the CC&R's have sequential numbering as a processing requirement. Each and every page of the CC&R's should be numbered using same numbering font/type.
7) UDC Sec.8.6.2.A.3: As an acknowledgement, please be aware that, as a separate inspection from grading permit inspections, assurable items as listed in the third party trust must be complete and accepted by the City of Tucson prior to final release of final plat assurances associated with this project.

For resubmittal, submit all assurance items as described above, all CC&R's applicable to this project, revised Final Plat sheets, title report, and response letter to comments.
