(RICK Engineering picked up the mylar last week) 2) Title reports were provided for only lot 1. Rachel Turnipseed from First American Title said she had noticed this as well and was going to or had already spoken with Dan on this. The City will also need the other title report to review for the other portion of the project to be platted. (RICK Engineering has since emailed a copy of Title Report for lot 2 which Jason will review) 3) One of the sewer easements on the Title Report for lot 1 is not shown or referenced on the plat. Recheck / clarify dkt7900 pg362 (item 8 on Schedule B). 4) City Atty's office stated that the CC&R's pages should be renumbered for pages 1-23, since they would not accept page numbering for 18A. 5) The assurances for this plat appeared to be a third party trust (that has been released per documentation from Rachel Turnipseed, First American Title) and a performance bond from the previous plat. The City may need copies of documentation (at minimum the bond should be updated with the new case #S11-014 prior to lot release). Check verbiage on mylar sheet 1 to assure that vestment (only and not assurance) is referred for the trust. These comments will be re-checked by Jason Green and will process follow-up. | 09/19/2011 | ELIZABETH LEIBOLD | ENGINEERING | REVIEW | Approved | DATE: September 20, 2011 SUBJECT: Business Park of the Desert Final Plat Submittal- Mylar Engineering Review TO: Patricia Gehlen, CDRC Manager LOCATION: 7000 S Palo Verde Road, T15S R14E Sec16 Ward 5 REVIEWER: Jason Green, CFM ACTIVITY: S11-014 SUMMARY: Engineering Division of Planning and Development Services Department has received the Final Mylar Final Plat, original Declaration of Covenant, Conditions and Restrictions for Business Park of the Desert, Title Report (dated 30AUG11), Final Release of Assurances letter for S08-110, and the new Performance Bond proposal. Engineering Division has reviewed the submitted Final Plat and CC&Rs and recommends approval of the Final Plat Mylar at this time. The following items need to be addressed for clarification prior to grading plan approval: PERFORMANCE BOND COMMENTS: 1) The proposed performance bond submitted has been accepted as a substitute assurance for Bond # 105541950, however the language in the performance bond needs to be revised to include the correct name of the new subdivision. Per the Title Block on the new Final Plat the name of the development should read; "Final Plat for Business Park of the Desert Lots 1 2, Blocks 1, 2, &3, and Common Area "A", Common Area "A": PAAL, Walkways and Landscaping Areas, S11-014." 2) Clarify in the performance bond the reference to "See item 6 of Agreement," specify which agreement the bond is referring to. PDSD Engineering has the authority to review/accept bonds without Mayor & Council involvement and PDDS intends to obtain another bond with the updated plat reference, or have them transfer the existing one for the new plat.
