The subject project has been reviewed. The project can not be approved at this time. Address the following comments before review can continue. Prepare a detailed response that explains the revisions that where made and references the exact location in the Final plat where the revisions were made:

Final Plat:

1. Since Student Way is proposed to be dedicated to the public by the Final Plat, the parcel shall be drawn with the future parcel lines.
2. All parts of Herbert Avenue and Arizona Avenue pavement and sidewalks that are proposed to be within the subject parcel must be dedicated to the public. Check with TDOT for additional information.
3. The angled parking on Fifth Avenue is partly in the public right of way and partly within the subject private parcel. If the parking is intended to be public, the entire parking area needs to be dedicated to the City. Check with TDOT for additional information.
4. Provide a copy of the TDOT letter of acceptance, concerning the proposed dedication of Student Way.
5. Generally, this Office requires that the proposed lay out including the proposed public right of way dedications and future parcel lines are acceptable to City of Tucson TDOT. All public right of way proposed dedications shall be clearly shown and the new parcel lines shall be drawn. Address this issue and submit a written verification of the proposed resolution of this matter.
6. Revise the Final Plat in accordance with the Tentative Plat revisions.

The drawings of the Final Plat for the proposed project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Regional Wastewater Reclamation Department (PCRWRD).This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The PDEQ and the PCRWRD hereby approve the above referenced submittal of the Final Plat received by us onMarch 08, 2011.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before February 02, 2012.

2. It is clear that DSMR and MDR application have been submitted for review and approval. List in the general notes the case numbers of both DSMR and MDR process in the lower right corner of the final plat sheets. List as general notes the case number and date of approval of each process

Previous Comment 3, DS 2-03.6.2.G - At this time it is not clear if any variances are required. Therefore until the review of the DP is completed this comment will remain until addressed. "If a Board of Adjustment variance is granted, provide the following note: This plat is subject to Board of Adjustment variance C10-11-_ _, unless expired or superseded by a subsequent application."

3. The response to the previous comment is acknowledged but Zoning cannot approve the final plat until there is confirmation from TDOT that the proposed street will be accepted as proposed. If area is to be accepted as right of way the final plat drawing should be clearly depicted as such. The dark heavy line should be should be used for the subdivision boundary and not include the proposed roadway.

DS 2-03.6.4.A - Prior to approval of the plat, a letter of acceptance from COT Transportation for the proposed 44-foot east-west right of away will be required. Also, clarify if the 13.60' easement along the northwest boundary of the site next to 5th Avenue is to be reserved specifically for the general public or are the residents of the development allowed to park as in this area. And if so how will this be enforced. I believe there should be mention that while this easement will be for public use this area will be maintained by the District Development. Consult with COT Transportation for direction on both these items.

4. After reviewing the final plat and comparing it with the development plan it has been noted and verified that a the eastern pedestrian easement (along Herbert Avenue) does not cover the sidewalk system as depicted on the development plan. The sidewalk on the development plan meanders and the easement only covers that area within five feet of the PL. Revise the easement to cover the entire sidewalk.

5. When will the abandonment documents be provided to CDRC / PDSD? At this time it is presumed that holds will be placed on issuance of permits until such time as those documents are provided.

6. Please be aware that additional comments may be forthcoming based on the responses to zoning comments and comments made on the development plan that could impact the final plat drawing.
