1. Section 5.3.8.2, LUC, permits a maximum of one year from the date of application to obtain approval of a development package. If, at the end of that time, the tentative plat/development plan has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this development plan is November 23, 2011.

2. This comment was not addressed. D.S. 2-03.2.2.B.5 & D.S. 2-05.2.2.B.3 Under General Note 2 remove "GENERAL MERCHANDISE SUBJECT TO SECTION 3.5.9.2c." as it is referenced under General Note 6.

3. D.S. 2-03.2.4.H &. D.S. 2-05.2.4.E GENERAL NOTE #47 states "PROPOPSED 15' WIDE R/W ADDITON BY FINAL PLAT BK_____, PG_____." Please clarify if this is a dedication of right-of-way. 5. D.S. 2-05.2.3.C Remove the "GATEWAY" reference from the plan as Silverbell is not listed on the MS&R Map as a Gateway Route.

6. This comment was not addressed. D.S. 2-05.2.4.D Provide a parking area access lane (PAAL) width dimension from what appears to be a concrete island, east of the drive-thru canopy, east to the curb.

The site is zoned R-2. Prior to the request for a change of zoning, the applicant was required to amend the Manzo Neighborhood Plan to allow for commercial development of the subject site at the northeast corner of Silverbell Road and St. Mary's Road. On September 8, 2010, Mayor and Council adopted Resolution 21613 amending the Manzo Neighborhood Plan to allow Neighborhood Commercial/Office/Low and Medium Density Residential on the 3.77-acre site.

Since then the site has been rezoned from R-2 to C-1 to allow for commercial uses. Based on the applicant's request, a concurrent review for both the Rezoning, C9-10-06 and Tentative Plat/Development plan, S10-051, is being conducted by staff. Prior to the approval of S10-051, it shall comply with any and all conditions approved through the Rezoning process. Therefore, the following revisions to the development plan, as outlined by staff are subject to the C9-10-06, rezoning conditions.

Staff offers the following comments on issues identified on the first review, which needed to be corrected and have yet to be corrected:

1. Landscape Plan, Sheet 1, does not comply with rezoning condition # 17. In staff's previous review, as part of comment #3, the following was requested;

At the northeast corner of the site provide a wider landscape area that includes trees. All landscaping to be provided at the time of the development of Lot 1.

Please revise landscape plan to provide enhanced landscaping on the northeast area of Lot 2. There is a portion of the northeast area of Lot 2 that is not part of the future parking area and could be enhanced with additional landscaping, with trees and other dense landscape vegetation. Landscaping to be on a permanent irrigation system.

2. Prior to Mylar approval, an approved reciprocal easement agreement (vehicular, pedestrian, and bicycle) shall be provided for Lots 1 and 2, as part of a cross parking agreement with the recordation shown in the General Notes, Sheet DP-1.

3. Please revise development plan to comply with rezoning condition #8, which reads:

All buildings for Lot 1 and future Lot 2 should be designed with "four-sided" architecture. Color elevations demonstrating compliance with this condition shall be submitted as part of the develop plan packet.

Please provide color elevations, with dimensions, showing that the architectural detail for the rear and sides, is comparable to the front façade.

4. Please revise landscape plan, sheet 2, need to add to each wall elevation (Option A, B, C, & D), language to state that each option of screen wall is graffiti-resistant.

5. Please revise development plan, sheet 2 and landscape plan, sheet 1, to show a pedestrian pathway along Sivlerbell Road that meets the direction provided by Mr. Howard Dutt from the Department of Parks and Recreation. E-mail dated April 20, 2011, provide by Mr. Dutt, states the pedestrian path shall be a minimum of ten feet wide. Current submittal indicates an eight foot wide pedestrian path.

6. Please revise development plan and landscape plan to show wall along the north boundary to be in compliance with rezoning condition # 13. Requires landscape areas with trees along both sides of the wall.

1) Revise the plans as necessary to clarify that the minimum width of the Silverbell Rd. Path is to be ten feet.

2) Sheet DP-2 still seems to indicate that the sidewalk from the corner of St Marys Rd north to the deceleration lane is to be left in place, contrary to what is requested above. (See April 20 email)

3) Excerpt from April 20 email: "Transportation's irrigation system on this parcel is currently inoperative. Transportation will require that the property owner add more trees in the right of way and that the property's irrigation system be used to water them. Furthermore, it should be noted on your plan that maintenance of these improvements in the right-of-way are the responsibility of the property owner."

Add additional trees and landscaping to the right of way on both sides of the Silverbell Path.

4) Revise the plans to include the Standards Note for ROW Planting:

1. It is the owners responsibility to keep the Sight Visibility Triangles (SVT), and the pedestrian access area clear of vegetation at all times, per Land Use Code (LUC) section
2. Final plant locations must be in compliance with all utility setback requirements.
3. The owner understands that if the City of Tucson Transportation Department or any utility company needs to work within the ROW in the landscaped area, plants and irrigation may be destroyed without replacement or repair.
4. The owner takes full liability for this landscape and irrigation, and any damage to roadway, sidewalk and utilities.
5. The only private irrigation equipment that is allowed within the ROW is polyethylene type tubing and emitters that are not under constant pressure. All other equipment must be on private property. (excluding water meter)
