Real Estate's comments regarding the proposed plat (strikeout = issue addressed; Bold = revised comment):
- in this case, since all the subject property is owned by the City, the unneeded and unused public right of way and ingress/egress easements serving City property that were created by the previous plat can be abandoned by labeling the items to be "Abandoned by this plat" and adding the following statement: "By approval and acceptance of this plat, the City hereby abandons that certain right of way dedicated as Avenida Acequia Primera and those certain ingress, egress easements identified herein as being abandoned by this plat." NOT COMPLETE.
- Additional comment: some of the ingress/egress easements were additionally and originally platted also as "Public utility and sewer easement". Since it would appear that these easements were never accepted by Pima County and the various utilities, these interests may now be revoked or abandoned. Please be clear in the labeling these easements what is intended to be abandoned (I am not going to note each one here).
- the abandonment language can also be made to apply to the access easement (technically out by merger of title) recorded in docket 6280 page 258 (mislabeled on page #3). NOT LABELED AS BEING ABANDONED BY THIS PLAT ON PAGE #2.
- Sheets 2 & 3; the Reclaimed Water Easement (Dk 8974, Pg 1515) is mislabeled and should read Dk 12084 at Pg 380. (the easement in Dk 8974, Pg 1515 has been abandoned...a couple of times). THE EASEMENT SHOULD BE SHOWN CONTINUING PAST THE NEW BLOCK LINE ON PAGE#2 AND SHOWN ON PAGE #3 AS IT NOW NOT SHOWN AT ALL ON PAGE #3.
- the abandonment process outline above can not be used on the Reclaimed Water Easement (Dk 12084, Pg 380) since there is an active line in place. This easement can only be abandoned after a new easement has been established and the active line has been relocated out of the existing easement area. Defer to Tucson Water to advise and provide further direction to Real Estate in this matter. (Not an objection, just a note to file that has been acknowledged by the engineer)
- page 2, mid Block 4, there appears to be an unlabeled easement entering the block from the west...please identify/label. The centerline of this easement appears to be an old block line, the centerline can be removed and ask that the engineer determine if the above comment regarding abandonment applies to this easement.
- page 2 & 3, Avenida Acequia Primera is not properly shown/labeled as right of way.

The existing Rio Nuevo Plat (57/40) calls the area abutting said Block 12 as "Common Area "B" Public Drainageway and Recreation". The excess/remnant portion of Block 12 that abuts Common Area "B", as I understand it, is intended to be owned, maintained and operated the same as said Common Area "B". To avoid any confusion later on I would recommend that this excess/remnant area be called out as Common Area and memorialized in an amendment to the CCR's of Rio Nuevo (11904-2528). The amendment could simply state that this new Common Area shall be owned, maintained, operated an incorporated with Common Area "B" in all respects.

The plat is acceptable so long as Gadsden/Psomas made the change to the plat drawing per the conversation below, and the attached e-mail and drawing. The change was at the southeast corner of Congress and Avenida del Convento (the northwest corner of their block).

Per Steve Pageau of URS (Designer for Streetcar):Received this on the 27th, so I hope they have made the change per our
drawings.

OK, weve made the change to our plat linework. Well update the linework
in the next day or so to the ftp site.
